Almanya’da arazi düzenlemesi

Arazi düzenlemesi parsellerin geometrik ve hukuki durumunu imar planlarına göre biçimlendiren, teknik altyapı ve sosyal donatı tesisleri için gereksinim duyulan alanların edinimini sağlayan ve düzenleme dolayısıyla oluşan değer artışını kamuya kazandıran bir arazi geliştirme yöntemidir. Görece adil, eşitlikçi, katılımcı ve düşük maliyetli bir yöntem olan arazi düzenlemesi Almanya, Avustralya, Endonezya, Fransa, Hindistan, İspanya, İsrail, Japonya, Kolombiya, Tayvan ve Türkiye (bkz. De Souza, 2018, s. 93-96) gibi pek çok ülkede uygulanmaktadır. Bu makale, kent imarında başarılı bir geçmişe sahip Alman arazi düzenlemesi uygulamalarının kurumsal ve teknik boyutlarına odaklanmaktadır. Bu amaçla Almanya’da arazi düzenlemesinin kurumsal çerçevesini oluşturan kadastral sistem, taşınmaz değerleme ve mekânsal planlama sistemleri genel olarak incelenmiş, ardından Alman arazi düzenlemesinin iş süreçleri, özellikle değer esaslı dağıtım yaklaşımı ve değer takdir ilkeleri açıklanmış ve örneklendirilmiştir. Makalenin değer esaslı arazi düzenlemesinin Türkiye’ye uyarlanmasına yönelik çalışmalara katkı sağlaması beklenmektedir.

Land readjustment in Germany

Land readjustment is a land development process, which forms geometries and legal status of land parcels according to detailed land use plans, acquires ownership of land needed for technical and social infrastructure facilities and captures value created by the development activities. It is a fair, equitable, participatory and cost-effective method applied in many countries, such as Germany, Australia, Indonesia, France, India, Spain, Israel, Japan, Colombia, Taiwan and Turkey (see De Souza, 2018, p. 93-96). This article focuses on institutional and technical aspects of the German land readjustment which has a history with great success in urban development. To this purpose, the institutional framework of the German land readjustment consisting of cadastral system, real estate valuation and spatial planning systems is investigated. Then, business processes of the German land readjustment, value-based reallocation methodology and valuation principles are explained and exemplified. This article is expected to provide contributions to works concerning to the adaptation of the value-based land readjustment method into Turkey.
