ONUNCU YILINDA BİRLEŞMİŞ MİLLETLER ENGELLİ KİŞİLERİN İNSAN HAKLARI SÖZLEŞMESİ VE SÖZLEŞME RUHU

Bu çalışma, Birleşmiş Milletler Genel Kurulu tarafından kabul edilmesinin üzerinden on yıla yakın bir süre geçen Birleşmiş Milletler Engelli Hakları Sözleşmesi'ne (CRPD) yönelik kısa bir değerlendirmeyi ve Sözleşme çerçevesinde engellilerin insan hakları yaklaşımda son yıllarda gelinen noktayı ortaya koymayı amaçlamaktadır. Literatürde bir "paradigma değişikliği" olarak adlandırılan Sözleşmeye bu özelliği sağlayan unsurlar bilhassa vurgulanmaya değer olduğundan, çalışma kapsamında Sözleşmenin ruhu olarak ifade edilebilecek bu prensiplerden öne çıkanların neler olduğu ve söz konusu prensiplerin gerek Sözleşme metni ve maddelerinde, gerekse uygulamada nasıl yorumlandığı ve hayat bulduğu konu edinilecektir

THE UN CONVENTION ON RIGHTS OF PERSONS WITH DISABILITIES IN A DECADE AND THE SPIRIT OF THE CONVENTION

This study aims to display the brief evaluation of the United Nations Convention on the Rights of Persons with Disabilities (CRPD), which has been adopted by the UN General Assembly for almost a decade ago, and to demonstrate the current stage reached regarding the human rights of persons with disabilities in line with the Convention. Since it is at most importance to emphasize those key principles which provide the distinct feature of the Convention which is phrased as a "paradigm shift"; the purpose of the study is to touch on these leading principles which could be identified as the soul of the Convention and to see how these principles are interpreted and realized through the Convention text, articles and practice
