Dolandırıcılık, gündelik hayatta bireylerin en çok karşılaştığı suçlardan birisi olarak karşımıza çıkmaktadır. Resmi rakamlar gösteriyor ki, suçun işlenme oranı günden güne artış gösteriyor. Bu nedenle, devletin bireylere etkin koruma sağlama yükümlülüğü daha da önem kazanmaktadır. Dolandırıcılık suçunun hileye ilişkin sorunları bu bakımdan özel incelemeye alınmalıdır. Hile unsurundan kaynaklı dört temel sorun gerek içtihatlarla, gerekse kanuni düzenlemelerle çözüme kavuşturulabilir. Öncelikle, basit hile suçun oluşumu için yeterli kabul edilmelidir. Böylelikle saf veya tecrübesiz kişilerin mağduriyetinin yaptırımsız kalmasının önüne geçilebilir. İkinci olarak, suçun ihmali hareketle kavuşturulmalıdır. Fraud is one of the most common crimes which people confront in everyday life. Official statistics indicates that the crime of fraud rates have been rising day by day. Therefore, the duty of the government to provide an effective protection increases in importance. In this regard, the problems on deception which raise the crime of fraud ought to be reviewed specifically. The four main problems which emerge from the deception element of fraud must be resolved through case-law and new legislations. Primarily, simple deception should be sufficient for the constitution of fraud. Thus, victimization of unexperienced and naïve people is not gone unpunished. Secondly, a new legislation is required in order to criminalize any fraud committed through negligence as a criminal act. And lastly, the offence of making off without payment and pyramid schemes should be distinguished as different criminal acts from fraud since the crime of fraud has failed to address these cases
