Hicrî dördüncü asırda, mezheplerin teşekkül süreciyle eş zamanlı olarak tartışılır hale gelen taklîd meselesinin kısa sürede çerçevesi çizilerek, ictihâd konusu ile birlikte bir bölüm şeklinde fıkıh usûlü kitaplarına dâhil edilmiştir. Bu konu ayrıca füru kitaplarında fetvâ ve kazâ bölümlerinde işlenmiştir. Bunun yanında münhasıran bazı müstakil çalışmalara konu olmuştur. Şâfi’î fakihlerinden Semhûdî’ye ait el-‘İkdü’l-ferîd fî ahkâmi’t-taklîd adlı eser, bu alanda yazılmış müstakil çalışmalardandır. Semhûdî, eserinde taklîdin meşruiyeti ve bağlantılı temel tartışma konularına yer vermektedir. Konu ile ilgili İslâm hukukçularının görüşlerine kapsamlı şekilde yer veren Semhûdî, kendi tercihlerini de ortaya koymayı ihmal etmemiştir. Semhûdî, Şâfi’î olmakla birlikte taklîd ile ilgili bazı temel konularda, Şâfi’î mezhebinin hâkim görüşünden farklı düşünmektedir. Bu çalışmada, Semhûdî’nin zikredilen eseri inceleme konusu edilmekte, onun taklîd ile ilgili görüşlerinin tespiti hedeflenmektedir. Semhûdî’nin, konu ile ilgili yaklaşımını tam olarak belirleyebilmek ve bir mukayese imkânını sağlamak amacıyla İslam hukukçularının görüşlerine de yer verilmektedir.

The issue of taqlîd was included in the books of the jurisprudence in the form of a chapter, together with the issue of ıjtihad, which became concurrent with the formation of the sects in the fourth century Hijri. This subject is also mentioned in the fürû’ ((substantive fiqh) books in the fatwa and Judgment sections. Besides, it has been the subject of some independent works. El-‘İkdü’l-ferîd fî ahkâmi’t-taklîd, -belonging to Semhûdî, one of the Shafi'i jurist, is one of the independent works written in this field. In his work, Semhûdî deals with the legitimacy of taqlîd and the main topics of discussion. Having included the views of Islamic jurists on the subject extensively, Semhûdî did not neglect to his own preferences. Semhûdî thinks differently from the prevailing view of the Shafi'i sect in some basic issues related to the taqlîd. In this study, the mentioned work of Semhûdî is examined, and it is aimed to determine his views on taqlîd.  The views of the Islamic jurists are given in order to determine the exact approach of Semhûdî and to provide a comparison opportunity.
