SİNGAPUR MİLLETLERARASI TİCARET MAHKEMESİ (SICC)

21. Yüzyıl ile birlikte, önceleri tahkim ve geleneksel devlet yargısı şeklinde yapılan ayrım farklı bir boyut kazanmıştır. Bazı devletler, sınıraşan ticarî uyuşmazlıkların çözümü bakımından kendi ülkelerini bir çekim noktası hâline getirmek istemişler ve bu tür uyuşmazlıkları inceleyen özel mahkemeler kurma fikrini geliştirmişlerdir. Tahkimin ve geleneksel devlet yargısının avantajlı yönlerini bir arada barındırma gayesiyle kurulan bu mahkemeler, milletlerarası ticaret mahkemeleri şeklinde adlandırılmaktadırlar. Bu çalışma, hâlihazırda kurulu bulunan örnekler arasında tercih edilebilirlik ve etkinlik yönünden avantajlı bir konumda olduğunu düşündüğümüz Singapur Milletlerarası Ticaret Mahkemesi’ni (SICC) ana hatlarıyla tanıtmak amacıyla kaleme alınmıştır. Aşağıda, öncelikle günümüzde faaliyet gösteren milletlerarası ticaret mahkemeleri hakkında genel bir bilgilendirme yapılacaktır. Ardından, SICC’nin temel yapısı ayrı başlıklar altında incelenecektir. Açıklamalar esnasında yeri geldikçe, özellik arz eden bazı hususlar açısından milletlerarası ticarî tahkim yolu ile karşılaştırmalar yapılacak ve SICC sisteminin güçlü ve zayıf yönlerine temas edilecektir. Sonuç kısmında ise, çalışmada yer verilen tüm açıklamalardan hareketle SICC’nin niçin diğer örneklere kıyasla daha güçlü bir alternatif teşkil edebileceği hususundaki kanaatimize yer verilecektir.
