YÖRÜNGE ALTI(SUB-ORBITAL) UÇUŞLARDA YOLCUNUN ÖLÜMÜ VEYA YARALANMASINDAN DOĞAN ZARARLAR NEDENİYLE TAŞIYICININ TABİ OLDUĞU SORUMLULUK REJİMİNİN TESPİTİ SORUNU

Teknolojinin gelişmesi taşıma türlerinin de çeşitlenmesine yol açmıştır. Teknolojik gelişmeler sonucu ortaya çıkan yeni taşıma türlerinden biri de yörünge altı taşımalardır. Şu an deneme aşamasında olan bu taşıma türünün yakında özellikle yolcu taşımaları açısından yaygınlık kazanması ise kaçınılmazdır. Yörünge altı taşımalar, hava taşımalarına oranla hızlı olması ve havayı daha az kirletmesi nedeniyle özellikle özel uçuşlar yerine tercih edileceklerdir. Yörünge altı taşımalardaki teknolojik gelişime rağmen, bu taşıma türünde hukuksal olarak ciddi bir gelişim kaydedilemediği görülür. Bu durum ise özellikle taşıyıcının taşıma sözleşmesinden kaynaklanan yolcunun ölümü ve yaralanmasından doğan sorumluluğunun hangi sorumluluk rejimine tabi olacağı hususunda sorun yaratacaktır. Taşıyıcının tabi olacağı sorumluluk rejimine ilişkin çeşitli görüşler bulunmakla beraber, ortak ve hâkim bir görüşten bahsedilmesi mümkün değildir. Çalışmamızda Öncelikli olarak yörünge altı uçuş kavramı ve türleri incelenerek, bu tür taşımalarda yolcunun ölümü ve yaralanması halinde taşıyıcının hangi sorumluluk rejimine tabi olacağı problemi cevaplandırılmaya çalışılacaktır.

THE PROBLEM OF DETERMINING THE LIABILITY REGIME OF THE CARRIER FOR DAMAGES ARISING OUT OF DEATH OR INJURY OF THE PASSENGER IN SUB-ORBITAL FLIGHTS

The development of technology has led to the diversification of transportation types. One of the new types of transportation emerging as a result of technological developments is sub-orbital transportation. It is inevitable that this type of transportation, which is currently in the trial phase, will soon become widespread, especially in terms of passenger transportation. Sub-orbital transportation will be preferred over private flights, as it is faster and less polluting than air transportation. Despite the technological development in sub-orbital transportation, it can be observed that there has not been a serious legal development in this type of transportation. This situation can create a problem while determining liability regime to be applied to the carrier in case of the death and injury of the passenger. Although there are various opinions regarding the liability regime to which the carrier will be subject, it is not possible to talk about a commonly approved and dominant opinion. In our study, firstly the concept and types of sub-orbital flights will be examined and then the question of which liability regime the carrier will be subject to in case of death or injury of a passenger in such transportation will be tried to be answered.
