ULUSLARARASI DENİZ HUKUKU KURALLARI IŞIĞINDA GEMİ TRAFİK HİZMETLERİ (VTS) SİSTEMİ VE OPERATÖRLERİNİN HUKUKÎ STATÜSÜ

Gemi Trafik Hizmetleri (Vessel Traffic Services - VTS), deniz trafiğinin güvenliğinin sağlanmasına yönelik bir seyir yardımı sistemidir. Bu sistem sayesinde; gemilerin konumları radarlar vasıtasıyla izlenmekte ve güvenli seyir için ihtiyaç duyulan her türlü bilgi gemilere iletilmektedir. Gemiler de güvenli seyir için gerekli önlemleri zamanında alabilmektedir. Dünya üzerinde uzun süredir VTS kullanılmasına rağmen, VTS sistemi ve operatörlerinin hukukî statüsü kesin olarak belirlenmemiştir. Bununla birlikte VTS sisteminin etkin bir şekilde işletilmesi aynı zamanda bu konuda ortak ilkelerin kabul edilmesine bağlı bulunmaktadır. Bu kapsamda çalışmada, VTS sistemi ve operatörlerinin hukukî statüsü açıklanmaya çalışılmıştır

THE LEGAL STATUS OF THE VESSEL TRAFFIC SERVICES (VTS) SYSTEM AND ITS OPERATORS IN THE LIGHT OF THE RULES OF INTERNATIONAL LAW OF THE SEA

Vessel Traffic Services (VTS) is a navigation aid system to ensure the safety of maritime traffic. Due to this system, the position of the vessels are monitored by radar and all kinds of information needed for safe navigation is transferred to the vessels. They can take the necessary measures for safety navigation in time. Despite the fact that VTS has been used around the world for a long time, the legal status of the VTS system and its operators hasn’t been defi ned clearly. However, at the same time, the efficient operation of the VTS system depends on the adoption of common principles about this issue. In this context, in this study, the legal status of the VTS system and its operators is tried to be explained.
