Koruma Sorumluluğu: İnsani Müdahaleyi Makyajlamak

Koruma Sorumluluğu, 2001 yılında, Müdahale ve Devlet Egemenliği Uluslararası Komisyon (ICISS) tarafından kabul edilmiştir. Koruma sorumluluğuna göre, Devlet, soykırım, savaş suçu, insanlığa karşı suç ve etnik temizlikten halkını koruması konusunda başlıca sorumludur. Eğer bir devlet, bu sorumluluğunu yerine getiremez ya da getirmek istemezse, uluslararası toplum Güvenlik Konseyi kanalıyla kolektif kuvvet kullanımını da içeren tedbir alabilecektir. Önleme , reaksiyon ve yeniden inşa sorumlulukları da koruma sorumluluğu kapsamına dahil edilmiştir. Koruma sorumluluğu, gerçekte retorik dışında insani müdahaleden farklı değildir. Koruma sorumluluğu ile BM Andlaşmasındaki 2/1 maddesinde düzenlenen, bütün devletlerin egemen eşitliği ve 2/7 maddesinde düzenlenen müdahale etmeme ilkeleri göz ardı edilmiştir.Yine de, ne Koruma Sorumluluğu ne de İnsani Müdahale uluslararası hukuka uygun ve meşru değildir

RESPONSIBILITY TO PROTECT: A MAKE UP TO HUMANITARIAN INTERVENTION

Responsibility to Protect is accepted by International Commission on Intervention and State Sovereignty (ICISS) in 2001. Responsibility to Act means that the State carries the primary responsibility for the protection of its population from genocide, war crimes, crimes against humanity and ethnic cleasing. However if a State is unwilling or unable to take its responsibility, the international community shall take measure, including the collective use, through the Security Council. Furthermore, international society should assume responsibility for preventing, reacting and rebuilding after humanitarian emergency. In fact, Responsibility to Protection does not diff er from humanitarian intervention except for rhetoric. The notion of Responsibility to Protect kind of by-passes the principle of the sovereign equality of all states as enshrined in Article 2/1 and the principle of non-interference as enshrined in Article 2/7 of UN Charter. Nonetheless neither Reponsibility to Protect nor Humanitarian Intervention abide by international law and thus legitimate
