İNTERPOL MEKANİZMALARININ BAŞTA SURİYE OLMAK ÜZERE BAZI ARAP DEVLETLERİ TARAFINDAN MUHALİFLERİNE KARŞI BİR ARAÇ OLARAK KULLANILMASININ HUKUKİLİĞİ SORUNU

Dünyada farklı yönetim şekillerine, dini inanışlara, ideolojilere, mezheplere ve ırksal kimliklere sahip yaklaşık 195 bağımsız devlet bulunmaktadır. Suçlulukla mücadele, zorunlu olarak, devletlerarası işbirliğini gerektirmektedir. Bu işbirliğinin sağlanması amacıyla İNTERPOL önemli bir rol oynamaktadır. Esasında İNTERPOL bu başarıyı Tüzüğü’nün 3. maddesinde ifade edilen politik, ırksal, askeri ve dini konulara karışmama ilkesine borçludur. Ancak son zamanlarda hukukun üstünlüğüne, insan haklarına ve temel hak ve özgürlüklere saygı göstermeyen kimi devletlerin ve özellikle devrim hadiselerine maruz kalan bazı Arap Devletlerinin terörizm ve yapay suçlamalarla İNTERPOL’ün mekanizmalarını muhalifl erine karşı, uluslararası hukuka aykırı olarak, kullandıkları ileri sürülmektedir. Bu makale, özellikle Arap Baharının son duraklarından biri olan Suriye’nin İNTERPOL mekanizmalarını hukuka aykırı olarak kullanması sorununu ele almak amacıyla kaleme alınmıştır

LAWFULNESS OF THE USE OF INTERPOL MECHANISMS, MAINLY BY SYRIA AND SOME ARAB STATES, AS A TOOL AGAINST THEİR OPPONENTS

In the world there are approximately 195 independent countries which have the diﬀ erent forms of government, religious beliefs, ideologies, sects and racial identities. Fighting crimes necessarily required interstate cooperation. INTERPOL plays an important role in order to achieve this cooperation. In fact INTERPOL owes this success to article 3 of its Constitution that expressed the principle of noninterference in political, racial, military and religious issues. However, in recent times it has been asserted that some states that do not respect the rule of law, human rights and fundamental rights and freedoms and especially Arab States that exposed to revolutionary events with terrorism and spurious charges uses INTERPOL mechanisms against the dissidents in violation of international law. This article in particular has been drafted in order to address the matter of, one of last station of Arab Spring Syria’s, use of INTERPOL mechanisms in violation of the law
