Avrupa Birliği Üyesi Ülke Uygulamaları Çerçevesinde TBMM’de Kanun Tasarı ve Teklifl erinin Komisyonlara Havalesi

Türkiye Büyük Millet Meclisi (TBMM) Başkanlığına sunulan kanun tasarı ve teklifl eri, TBMM’de ilgili ihtisas komisyonlarında görüşülmektedir. Konunun hangi ihtisas komisyonunda görüşüleceği, meri mevzuat ve teamüller çerçevesinde TBMM Başkanlığı tarafından belirlenmektedir. Ancak konunun hangi komisyonun faaliyet ve yetki alanına girdiği çoğu zaman tartışma konusu olmaktadır. Komisyonların işyükü dağılımı açısından da Plan ve Bütçe Komisyonu ile Dışişleri Komisyonu aleyhine ciddi bir dengesizlik bulunmaktadır. Bu çerçevede TBMM’de havale işlemlerinde halen oturmuş bir sistem bulunduğu söylenemez. Bu çalışmada, TBMM’de havale işlemleri, bazı AB üyesi ülke uygulamaları da ele alınarak incelenecek ve öneriler getirilmeye çalışılacaktır. Kanun tasarı ve teklifl erinin dışında ayrıca kanun hükmünde kararnamelerin, dokunulmazlık tezkerelerinin, Sayıştay raporlarının ve 5018 sayılı Kanun kapsamındaki bazı raporların ilgili komisyonlara havalesi söz konusu olabilmektedir. Çalışmamız kapsamında sadece kanun tasarı ve teklifl erinin komisyonlara havalesi konusu incelenecektir. Komisyonların işyüklerinin değerlendirilmesinde 21., 22. ve 23. yasama dönemleri esas alınmıştır

THE REFERRAL OF BILLS AND PROPOSALS TO THE COMMITTEES IN THE PARLIAMENT OF TURKEY IN THE CONTEXT OF EUROPEAN UNION MEMBER STATES PRACTICES

The bills and proposals submitted to the Presidency of the Parliament of Turkey are debated in the related standing committees. Presidency of the Parliament is authorized to determine in which committee the matter be debated. The competence of the committees is a subject of confl icts between the committees most of the time. There is also a inequility between the committees in terms of their work load against the Plan and Budget Committee and Foreign Affairs Committee. In this context there isn’t a institutionalized system in terms of referral procedure in the Parliament of Turkey. In this paper, the referral procedure in the Parliament of Turkey is studied to analyze and make suggestions in terms of some EU Member States’ practices. The referral of the decrees having the force of law, inviolability certifi cates, Court of Auditors’ reports, the reports in the context of the Law numbered 5018 are not discussed and for making evaluation of the standing committees’ work load, the 21 st, 22 nd and 23 rd legislative terms are included in the context of this paper.
