Gözlem altına alma kurumu, Ceza Muhakemesi Kanunu’nun 74. maddesinde düzenlenmiştir. Bu düzenlemeye göre suçu işlediği konusunda kuvvetli şüphe bulunan şüpheli veya sanığın akıl hastası olup olmadığının ve eğer akıl hastası ise ne zamandan beri akıl hastası olduğunun ortaya çıkarılması gerekmektedir. Ceza hukuku sistemi içerisinde yapılacak olan bu inceleme için, öncelikle uzman bir hekimin bu konuda önerisi olmalı ve bu öneri üzerine hâkim veya mahkeme, şüpheli veya sanığın resmi bir sağlık kuruluşunda kusur ehliyetinin incelenmesine karar vermelidir. Bu inceleme süre ile sınırlanmıştır. Gözlem süresi ancak üç hafta olabilecek, resmi sağlık kuruluşunun talebi üzerine bu süre üç aya kadar uzatılabilecektir. Temel hakları kısıtlama özelliği dolayısıyla kurum, bir koruma tedbiri olarak nitelenebilir.

The stationary mental (state) examination is regulated by Article 74 of the Criminal Procedure Code. According to this provision, if strong indications of suspicion are present, which tend to show that the suspect or the accused committed the criminal conduct; then it is required to expose whether the suspect or the accused is mentally ill, and if so, the duration of the illness. For this analysis to be performed, first of all there shall be a proposal of the expert; and then upon this proposal the Justice or the trial court shall decide that the suspect or the accused shall be stationed in a public medical center in order his/her capacity to commit a crime to be examined. The period of this examination is limited. The stationary examination period may be three weeks. This period can be extended upon the motion of the public medical center, but the period cannot exceed three months. The institution of stationary mental examination can be described as a (provisional) measure of protection, as it restricts the fundamental rights.
