Avrupa Birliği’nde İdari İşbirliği Modeller ve Perspektifler

Avrupa Birliği birliğe üye devletlerin ulusal idareleri ile Avrupa Birliği’nin kendi idaresi arasında yakın bir işbirliği oluşturmuştur. Bu işbirliği Avrupa Birliği’nin farklı faaliyet alanlarında çok farklı şekillerde ortaya çıkmaktadır. Avrupa Birliği mevzuatının icrası geleneksel olarak doğrudan (Avrupa Birliği’nin kendi idaresi, özellikle de Brüksel’deki Avrupa Komisyonu tarafından) ve dolaylı (üye devletlerin idareleri tarafından) icra şeklinde ikiye ayrılmaktadır. Ancak bu ikili ayrım farklı icra şekillerini tam olarak kapsamamaktadır. Günümüzde Avrupa Birliği’ne üye devletlerden birinin aldığı idari kararların başka bir üye devlette oluşturduğu ulusötesi etki çok önemli bir anlam ifade etmektedir. Bu çalışmada icra ve işbirliği konularındaki çeşitliliği kapsayıcı farklı modeller önerilmekte ve işbirliğinin işlevi incelenmektedir. Avrupa Birliği usul hukuku şimdiye kadar kapsamlı bir şekilde kodifiye edilmemiştir. Bu nedenle bu çalışmada Avrupa Birliği idare hukukunun kodifikasyonu perspektifleri konusuna da değinilmektedir. Avrupa Birliği’ne üye devletlerin idari yapıları arasında farklılık olduğu için, öncelikle Avrupa Birliği’nin idari yapısının gelişimi açısından hangi hususların (kararların hukuka uygunluğu, usul kurallarına uygunluk, verimlilik ve etkililik gibi) merkezi öneme sahip olması gerektiği konusunda mutabakata ihtiyaç vardır.

Administrative Cooperation in the European Union Models and Perspectives

Administrative cooperation between national and European administrations within the European Union is a central feature of European administrative law. The forms of administrative cooperation differ from subject to subject. Traditionally, lawyers would oppose centralized or direct community administration (by the EU administration, in particular by the European Commission in Brussels) to indirect administration (by the administrations of the member states). However, this dualism does not give a complete picture of the different forms of administration. Transnational effects of an administrative decision taken in one member state in other member states are of crucial importance today. The article proposes several models that can serve to describe the plurality of administrative decision making and cooperation within the European Union and outlines the functions of administrative cooperation. The law of administrative procedure of the European Union has not been fully codified so far. The article therefore discusses perspectives of a codification of European administrative law. As the legal traditions of administrative law differ from member state to member state, a codification will require a decision on the basic features that will structure European administrative law (such as lawfulness, procedural appropriateness, efficiency, acceptance).
