Uluslararası Taşımacılık Sözleşmeleri Açısından İnsansız Gemilerde Denize Elverişliliğe Genel Bir Bakış

Deniz taşımacılığı dünya ticaretinde çok önemli bir yere sahiptir. İnsansız gemilerin ise gelecekte bu sektörde kritik konumda olacağı öngörülmektedir. Uzun süredir insansız gemilerle ilgili hem özel sektör hem de devletler tarafından çalışmalar yürütülmektedir. Belirtmek gerekir ki insansız gemilerle ilgili teknik çalışmalar yapılırken, hukuki yönlerinin tartışılması ve yapılacak düzenlemeler için öneriler sunulması, sektörün insansız gemilere olan güvenini artıracaktır. Bu çalışmada, hem deniz hukukunun temel taşlarından biri olan hem de onun kadar eski bir tarihe sahip olan denize elverişlilik kavramına insansız gemilerde nasıl yaklaşılacağı ile ilgili değerlerlendirmeler yapılmıştır. Bu değerlendirmeleri ise denizde mal taşınmasını düzenleyen en önemli uluslararası anlaşmalarından olan Lahey-Visby Kuralları, Hamburg Kuralları ve Rotterdam Kuralları’na göre yapmıştır. İnsansız gemilerde denize elverişlilik kavramı ile ilgili genel bir bakış açısı ortaya konulmaya çalışılmış ve gemide mürettebatın bulunmaması ve ekipmanların durumuna ilişkin yorumlar yapılmıştır. Denize elverişliliğin geleneksel gemilerde nasıl ele alındığına değinerek, denize elverişliliğin amacının gemilerin güvenli bir şekilde seyrüsefer etmesi olduğu belirtilerek, insansız gemilerde de bu hususun odak noktası olması gerektiği sonucuna ulaşılmıştır.
