Amerika Birleşik Devletleri (ABD) ceza muhakemesi sistemi savunma makamının iddia makamı karşısında güçlendirilmesi hususunda Kıta Avrupası ülkeleri için yüksek bir standart teşkil etmektedir. Kara Avrupası ile kıyaslandığında AngloAmerikan ceza yargılaması mekanizmasında “silahların eşitliği” oldukça uzun bir süredir var olan bir ilkedir. ABD’de 20. Yüzyıl’ın ortalarından beridir iddia-savunma dengesini sağlamak için kullanılan iki önemli aygıt “Savunma Araştırması” ve “Savunma Kriminoloji/Adli Tıp Kurumları”dır.

A Comparative Look at the American Criminal Justice System from the Perspective of the Defense and the Counsel for the Defense

The criminal procedural system of the United States of America (USA) currently sets a high standart the countries of Continental Europe in the name of strengthening the position of the defense vis a vis the prosecution. The equality of arms has been a long-established principle in the Anglo-American criminal justice mechanism when compared with the other shore of the Atlantic. Since the midst of the 20th Century, two of the most important American instruments to realize the ideal equlibrium position for the prosecution and defense has been “the Defense Investigation” and “the Forensic Criminology Services for the Defense”.
