Avrupa Birliği’nde Çapraz Uyum ve Türkiye İçin Öneriler

Avrupa Birliği’nde AB doğrudan ödemeleri alan tüm çiftçiler için zorunlu bir uygulama olan çapraz uyum, AB katılım müzakereleri kapsamında Fasıl 11 Tarım ve Kırsal Kalkınma altında ele alınmaktadır. Müzakere Çerçeve Belgesi’nde belirtildiği üzere, Türkiye’nin AB’ye katılımı için AB müktesebatını katılım tarihindeki haliyle uygulaması, dolayısıyla çapraz uyum alanındaki AB mevzuatının da ulusal mevzuata aktarılması ve uygulanması gereklidir. AB uyum çalışmaları kapsamında, Türkiye’de henüz doğrudan çapraz uyum kurallarını düzenleyen ve çapraz uyum uygulamasından sorumlu makamları tanımlayan hukuki bir dayanak bulunmamaktadır. Bu çalışmada, AB çapraz uyum uygulamalarını düzenleyen yasal çerçeve, Üye Devlet uygulamaları ve Türkiye’de çapraz uyumla ilgili yapılan çalışmalar incelenmiş ve çalışmanın yapılan öneriler ışığında, ülke koşullarına uygun çapraz uyum kriterlerinin oluşturulmasından sorumlu ve yetkili ulusal makamların çalışmalarına katkı sağlaması hedeflenmiştir

Cross compliance obligatory implementation for all farmers receiving direct payments is dealt with under Chapter 11 Agriculture and Rural Development, within the scope of EU accession negotiations. As indicated in the Negotiating Framework, Turkey will have to apply the acquis of the EU as it stands at the time of accession, thereby requiring that EU legislation in the field of cross compliance is transposed to national legislation and it is implemented. There is no legal basis for regulating cross compliance rules and defining responsible authorities for implementing crosscompliance in Turkey. In this study, the legal framework regulating cross compliance implementations in the EU, the EU Member States’ cross compliance implementations and studies on cross compliance in Turkey were examined, and in the light of recommendations made in the study, it is aimed at contributing to studies of national competence authorities responsible for establishing cross compliance criteria suitable for country conditions.
