CEZA HUKUKUNDA İNSAN HAKLARININ KORUNMASI

Bu makalenin temel dayanak noktasını, bağlayıcı uluslararası hukuki sorumluluklar, insan haklarının gerçekleşmesi ve ceza hukukunun kapsamı konularındaki insan hakları analizler oluşturmaktadır. Mevcut çalışmanın sonuçları, ceza sistemleri arasında yapılan uluslararası karşılaştırmalı analizler, ABD yasal söyleminde devletin cezalandırma gücü ve Amerikan ceza uygulaması konusundaki önceki araştırmalarla aynı yöndedir.

THE PROTECTION OF HUMAN RIGHTS IN CRIMINAL LAW*

The mainstay of the paper is formed by an analysis of human rights as the subjects of binding international legal obligations, the realization of human rights, and the scope of criminal law. The results of the current study converge with prior research on international comparative analysis among penal systems, the penal power of the state in American legal discourse, and U.S. penal practice.
