TIBBİ MALPRAKTİS, TIBBİ MALPRAKTİSİN PSİKOLOJİK BOYUTLARI VE ÖZEL HASTANEDE ÇALIŞAN HEKİMİN TIBBİ MALPRAKTİSTEN DOĞAN HUKUKİ SORUMLULUĞU

Sağlık hakkı, en temel insan haklarındandır. Sağlık hizmeti verilirken meydana gelebilecek istenmeyen sonuçlardan hastanın korunması, olumsuz sonuç ortaya çıkmış ise zararın en aza indirgenmesi ve aynı zamanda sağlık çalışanının hukuki güvenliğinin sağlanması açısından hukuki ve cezai sorumluluk kapsam ve koşullarının incelenmesi gerekmektedir. Çalışmamız özünde disiplinler arası bir çalışmadır. Zira tıp, etik, psikoloji ve hukuk birbirlerini dışlayan değil tamamlayan alanlardır. Tıbbî malpraktis nedeniyle ortaya çıkan sorumluluk, bir yandan hekimin mesleki etkinliklerini gerçekleştirdiği bir hastane organizasyonu içerisinde hastane işletmecisi ile kurduğu iş çalışma ilişkisinin konu, amaç, kapsam ve içeriğine; diğer yandan hastanın hastane karşısındaki hukuksal konumuna göre önemli farklılıklar göstermektedir. Bu nedenle, ortaya çıkabilecek sorumluluk hukuku sorunlarının çözümlenmesinde, gerek hekim ve hastane arasındaki hukuki bağın, gerek hastanın hastane ve/veya hekim ile kurduğu sözleşmesel borç ilişkilerinin içeriği araştırılıp, buna göre uygulanacak kuralların belirlenmesi gerekmektedir.

Medical Malpractics, Psychological Dimensions Of Medical Malpractice And Physician’s Legal Responsibility

The right to health is the most basic human rights. When the health care service is given, it is necessary to examine the scope and conditions of legal and criminal liability in order to protect the patient from unintended consequences and to minimize the harm if the negative result occurs and at the same time to ensure the legal security of the healthcare worker. Our work is essentially an interdisciplinary work. Because medicine, ethics, psychology and law are complementary but not complementary fields. The responsibility arising from medical malpractice is based on the subject, purpose, scope and content of the work relationship established with the hospital operator within a hospital organization where the physician performs his/her professional activities; on the other hand, there are significant differences according to the legal position of the patient in the face of the hospital. For this reason, it is necessary to investigate the legal relationship between the physician and the hospital, the contents of the contractual debt relations established by the hospital with the hospital and/or the physician, and the rules to be applied accordingly.
