MANEVİ HAKLARIN TÜRK TELİF HUKUKUNDAKİ TARİHÎ GELİŞİMİ

Türkiye’de telif haklarının korunmasına ilişkin ilk kanunî düzenlemeler, 19’uncu yüzyılda kabul edilmiştir. Bugün, Türk telif hukukunda, eser sahipleri için altı geniş manevi hak grubu tanınmaktadır: i) umuma arz hakkı; ii) eser sahibi olarak tanıtılma hakkı; iii) eserde değişiklik yapılmasını önleme hakkı; iv) eserin aslına ulaşma hakkı; v) eseri tahrip etmeyi önleme hakkı ve vi) sergileme hakkı. Türk hukukunda icracı sanatçılara da icra sahibi olarak tanıtılma hakkı ve icrada değişiklik yapılmasını önleme hakkı tanınmıştır. Bu makalenin amacı, manevi hakların Türkiye’deki tarihî gelişimini incelemektir. Bu amaçla, makalede Osmanlı İmparatorluğu dönemine kadar uzanan manevi hakların tarihî gelişimi incelenmektedir. Buna ilaveten, cumhuriyet döneminde kabul edilen altı tür manevi hak ve her bir hakkın mevcut olduğu ölçüde yargı kararlarındaki yorumu ele alınmaktadır. Son olarak makalede, Türk telif hukukundaki manevi haklar kavramının teorik ve pratik çerçevesi çizilmektedir.

HISTORICAL DEVELOPMENT OF MORAL RIGHTS IN TURKISH COPYRIGHT LAW

In Turkey, early statutory arrangements for the protection of copyright were drafted in the 19th century. Today, Turkish copyright law provides six broad categories of moral rights for authors. These are: i) the right of disclosure; ii) the right of attribution-paternity; iii) the right of integrity; iv) the right of access; v) the right to prevent destruction; and vi) the right of exhibition. Under Turkish law, performers are also granted ‘the right of attribution-paternity’ and ‘the right of integrity’. The object of this article is to analyze the historical transformation of the moral rights in Turkey. To this end, this article explores the historical development of moral rights by going as far as back to the era of the Ottoman Empire. It additionally examines six types of moral rights that has been adopted in the republican period by presenting the judicial exegeses of each right, where available. Finally, the theoretical and practical framework of the concept moral rights under Turkish copyright law is portrayed by the article.
