Telekomünikasyon yoluyla yapılan iletişimin denetlenmesi, temel insan hakları içinde yer alan haberleşme hürriyeti ve özel hayatın gizliliğine müda­hale anlamı taşımaktadır. Bu nedenle denetleme tedbirinin sıkı koşullara bağ­lanması gerekir. Tedbir kararlarının şekil şartlarına ilişkin denetim görevini üstlenmek ve kararların tek elden uygulanmasını sağlamak amacıyla ülke­mizde Telekomünikasyon İletişim Başkanlığı adı altında teknik bir idari birim oluşturulmuştur. Telekomünikasyon İletişim Başkanlığı'nın idare, ceza ve ceza muhakemesi boyutuyla kamu hukukundaki yerini konu edinen bu çalışmada, Başkanlığın kuruluşu, tarihçesi, Türk idari teşkilatı içerisindeki konumu, Baş­kanlık ve bünyesindeki alt birimlerin yasa ve yönetmelikte düzenlenen görev ve yetkileri ele alınmaya çalışılacak; Başkanlığın denetiminin ve Başkanlık tara­fından gerçekleştirilen denetimin nasıl yapıldığına uygulamadan örneklerle değinilecek ve son olarak böyle bir kurumun Türkiye için gerekli olup olmadığı sorusu üzerinde durulacaktır. Anahtar Kelimeler: Telekomünikasyon İletişim Başkanlığı, telekomüni­kasyon yoluyla yapılan iletişimin denetlenmesi, tedbir kararlarının denetimi, mukayeseli hukukta tedbir kararlarının uygulanması, Başkanlığın önemi. ABSTRACTMonitoring of communication through telecommunications has the meaning of intervention to freedom of communication and the privacy of private life that contained in the fundamental human rights. A technical administrative unit under the name of Telecommunications Presidency established in our country to undertake the task of auditing regarding form requirements and ensure the implementation of decisions from a single source. In this study which obtain the subject administrative, criminal and criminal procedure aspects in public law, will be addressed to establishment, history, position within the Turkish administrative organization of Presidency and the duties and powers to law and regulation of Presidency and subunits in its structure; will be mentioned with application examples how to do the presidential supervision and the audit conducted by the Presidency and finally will focus on the question whether such an institution is necessary for Turkey. Keywords: Telecommunications Presidency, monitoring of communication through telecommunications, audit of measure decisions, implemantation of measure decisions at comparative law, the importance of the Presidency.
