Sağlık hukuku alanında genellikle hekimlerin hukuki sorumlulukları ele alınmıştır. Oysa ki hekimler kadar diş hekimlerinin de hukukî sorumlulukları gerçekleştirdikleri tıbbi müdahaleler açısından önemlidir. Kamu sektöründe çalışan diş hekimlerinin hukukî sorumluluğu kamu hukukuna tabidir. Kamu hastanelerinde çalışan bir diş hekiminin gerçekleştirdiği tıbbî müdahale sonucu zarar gören hasta devlete karşı dava açar. Ancak, özel muayenehanesinde mesleğini icra eden diş hekiminin fiili sonucu zarar gören hastalar, diş hekimlerine özel hukuk hükümlerine göre başvurabileceklerdir. Hasta, özel hukukun sorumluluk hukuku çerçevesinde sözleşme öncesi sorumluluk, sözleşme, haksız fiil ve vekâletsiz iş görme hükümlerine dayanarak dava açabilir. Diş hekiminin hukuki sorumluluğuna karar verilince hasta maddi ve manevi tazminata hak kazanır. Davalar, tıbbî müdahaleyi gerçekleştiren hekime karşı açılır.

The legal responsibility of the physicians has been discussed largely in the field of health law. Yet, the legal responsibilities of the dentists as well as physicians are important in terms of medical interventions. The legal responsibility of the dentists working in the public sector is subject to public law. The patient suffering as a result of a medical intervention realized by a dentist working in the public hospitals files a lawsuit against the state. However, the patients suffering as a result of a deed realized by a dentist performing her/his profession in the private clinic will be able to resort to the dentists according to the provisions of private law. The patient can file a lawsuit based on the provisions of pre-contractual liability, contract, tortious act and negotiorum gestio within the framework of liability law of private law. If it is decided that the dentist has a legal responsibility, the patient is entitled to pecuniary and non-pecuniary compensations. The lawsuits are filed against the dentist who realizes the medical intervention.
