CEZA HUKUKU BAĞLAMINDA SİVİL İTAATSİZLİK ÜZERİNE BAZI DEĞERLENDİRMELER

Sivil itaatsizlik hem siyaset biliminin hem de hukuk felsefesinin güncel konularından biridir. Sivil itaatsizlik, özellikle Batı dünyasında tartışmalara konu olmuş ve üzerine birçok eser yazılmıştır. Ülkemizde de sivil itaatsizliğin incelendiği çalışmalar vardır. Bu çalışmanın amacı sivil itaatsizliği salt siyasi veya felsefi boyutuyla değil, hukuki boyutuyla da değerlendirmektir. Sivil itaatsizliğin hukuki boyutuna ilişkin tartışmaların önemli bir kısmıysa temelde sivil itaatsizlik eylemlerinin diğer suç konusu eylemlerden farklılıkları ve bu farklılıklara binaen sivil itaatsizlik eyleminde bulunanların cezai sorumlulukları, cezayla karşılaşacaklarsa hangi tür ve miktar cezayla yüzleşmeleri gerektiğinin belirlenmesinde düğümlenir. Şüphesiz bu tartışmalar doğrudan ceza hukukuyla ilgilidir. Bu çalışmada suç genel teorisi açısından sivil itaatsizlik eylemleri değerlendirilecektir. Yalnız bu değerlendirme yapılmadan önce, sivil itaatsizliğin tarihi, felsefi ve siyasi boyutlarına, tartışmaya ışık tutmak amacıyla gerektiği ölçüde değinilecektir.

Some Evaluations on Civil Disobedience in the Context of Criminal Law

Civil disobedience is one of the current issues of both political science and philosophy of law. Civil disobedience has been the subject of controversy especially in the western world and many works have been written on it. There are also studies of civil disobedience in our country. The aim of this study is to evaluate civil disobedience not only from the political or philosophical point of view, but also from the legal point of view. An important part of the debate over the legal dimension of civil disobedience is that the differences between civil disobedience actions from other criminal acts and the criminal responsibilities of those who commit civil disobedience based on these differences are tied to the determination of what kind and amount of punishment they should confront if they meet criminal charges. Undoubtedly, these arguments are directly related to criminal law. In this study, civil disobedience actions will be evaluated in terms of the general theory of crime. Before this assessment is made, however, it will be addressed to the extent necessary to shed light on the history, philosophical and political dimensions of civil disobedience and debate.
