AVRUPA BİRLİĞİ'NİN AVRUPA İNSAN HAKLARI SÖZLEŞMESİ'NE KATILIMININ İNSAN HAKLARI YARGISINA ETKİLERİ

Avrupa Birliğ inin örg üt olarak Avrupa İnsan Hakları Konvansiyonuna taraf olması yıllardan beri tartışma konusu olmuştur. Tartışmala- rın odağ ında devletlerin katılımına açık olan Avrupa İnsan Hakları Konvansiyonunun örg ütlerin katılımına müsait olmaması hususu yer almıştır. Lizbon Antlaşmasının yürürlüğe g irmesi ve 14. Protokolün kabulüyle birlikte mevzuattan kaynaklanan temel tıkanıklığ ın aşıldığ ı değerlendirilmektedir. Ancak Avrupa Birliğ i vatandaşları için bireysel başvuru mekanizmasının bürüneceğ i biçim ve uyg ulanacak usuller- le, Adalet Divanı içtihatlarında otonom mahiyette kabul edilen Birlik hukukunun katılım sonrası uğ rayacağ ı değ işime ilişkin temel birtakım sorunlar çözüm beklemeye devam etmektedir. Birliğ in üye devletler için bağlayıcı olan Konvansiyona taraf olmasıyla birlikte örg üt olarak Konvansiyon hükümleriyle bağlı hale gelmesini destekleyen görüşler ağ ırlık kazanmıştır. Bununla birlikte katılım antlaşmasının uyg ulan- ması aşamasında doğacak çok sayıda teknik soruna ilişkin çözümler üzerinde uzlaşma sağlanamamıştır. Çalışmamızda Birliğ in ve Avrupa Konseyinin katılım sürecinde karşı karşıya kalacağ ı teknik sorunlar ve bunların muhtemel çözümleri üzerine değerlendirme yap ılmaktadır.

J UDICIAL EFFECTS OF THE EUROPEAN UNION S ACCESSION TO THE EUROPEAN CON VEN TION ON HUMAN RIGH TS

The accession of the Europ ean Union to the Europ ean Convention on Human Rights has been deliberated f or an extended p eriod of time. Dis- cussions on the top ic have largely f ocused on the f act that the Europ ean Convention was not op en to the accession of international organisations, but only to state parties. However, with the entry into f orce of the Lis- bon Treaty and Protocol 14 to the Europ ean Convention, the main ob- stacles to accession have been removed. Nonetheless, there still remain f undamental questions surrounding the p rotection of individual rights in the Strasbourg Court as well as the autonomy of Europ ean Union law. There are very good arg uments in f avour of accession because if realized the Europ ean Union would thus be subj ected to external control by the Europ ean Court of Human Rights as is already the case f or its Member States. On the other hand, many technical p roblems related to the ac- cession still need to be addressed. In f act, the unresolved status of these issues constitute the p rimary reason why an ag reed solution has yet to be reached. With these complexities in mind, this study seeks to p robe the outstanding questions and p roblems related to the accession p rocess while also p osing p ossible solutions that both the Europ ean Union and the Council of Europ e could ag ree on.
