Uluslararası hukukta kuvvet kullanma açısından soğuk savaş sonrası dönemde nato ve terörizmle mücadele

Bu çalışmada Soğuk Savaş sonrasında ortaya çıkan uluslararası ortam, yeni ulu- sötesi tehditler ve özelde terörizm konusu incelenmektedir. Bu bağlamda NATO’nun tutumunun nasıl geliştiği, Kasım 2010’da kabul edilen “Aktif Katılım, Modern Sa- vunma” başlıklı Stratejik Konsept belgesi ile ortaya konulmaya çalışılmaktadır. So- ğuk Savaş döneminde Batı’ya ait bölgesel savunma örgütü olan NATO, genişleme ve transformasyon sonucunda günümüzde artık sadece Batı’ya değil gelişmiş Kuzeye de ait, bölgesel değil küresel tehdit değerlendirmesinde bulunan, klasik değil ulusötesi tehditlere karşı da strateji ve konsept geliştiren bir uluslararası güvenlik mekanizması olmuştur. 1991 ve 1999 tarihli NATO Stratejik Konseptlerinde terörizm bir tehdit un- suru olarak değil risk çeşidi olarak algılanmıştır. 11 Eylül 2001’de yaşanan terör sal- dırıları sonrasında NATO içerisindeki mevcut algı ve tutum dramatik şekilde değişmiş ve ilk kez Washington Antlaşmasının 5’nci maddesine başvurulmuştur. 2010 Stratejik Konsepti ile NATO, klasik tehdit algılamasının ötesine geçerek terörizm gibi ulusötesi tehditlerin zikredildiği modern güvenlik anlayışı ve küresel farkındalıkla İttifakı alan dışına çıkarmış ve küresel çerçevede çatışma önleme ve istikrar sağlama vizyonu or- taya koymuştur. Ortaya çıkacak bir terör tehdidi karşısında İttifakın vereceği “temel güvenliğin tehlikede olduğu ve kuvvet kullanmak üzere harekete geçilmesi” gerektiği kararı, ABD liderliğinin tek taraflı veya çok taraflı dış politika tercihine bağlı ola- rak; uluslararası hukukta kuvvet kullanımına ilişkin klasik / geleneksel veya neorealist okulların görüşlerinin hangisinin benimseneceği konusunda uluslararası ilişkilerde, terörizmle mücadelede ve NATO’nun kendisi açısından önemli sonuçlar doğurabilir.

NATO and the fight against terrorism in the post cold war era within the perspective of use of force in international law

In this article, the international enviroment, the new transnational threats and par- ticularly the subject of terrorism in post cold war are analyzed. Within this regard, it is aimed to show how NATO’s policy has been developed with the Strategic Concept 2010 document: “Active Engagement, Modern Defence” accepted on November 2010. As a result of transformation and enlargement policy, NATO has become an interna- tional security organization which belongs not only to the West, but also the North and evaluates not only the regional and classical but also the global and transnational threats. However, in 1991 and 1999 Strategic Concepts, terrorism was perceived as one of the security risks and not as a threat. The 9/11 terrorist attacks of 2001 changed this perception dramatically and the Alliance triggered the Article 5 of the Washington Treaty. With the Strategic Concept 2010, NATO has moved the Alliance out of the area by going beyond the classical threat perception with the global awareness and the modern security perception which explain the transnational threats like terrorism. In a case where the Alliance will make a determination stating that “the security is at dan- ger and it is necessary to take action to use force” against an emerging terrorist threat, subject to the American leadership’s unilateral or multilateral foreign policy choice, dealing with whether classical / traditional or neorealist school’s view regarding the use of force in international law will be accepted will have very important effects on the international relations, the fighting against terrorism and NATO itself.
