SURİYE’DEKİ SİLAHLI ÇATIŞMALAR KARŞISINDA MONTRÖ BOĞAZLAR SÖZLEŞMESİ’NİN HUKUKİ ANALİZİ

Suriye krizi sebebiyle Türk boğazlarının kullanımı meselesi yeniden gündeme gelmiştir. Bilindiği gibi Montrö Boğazlar Sözleşmesi, Türk boğazlarından geçiş rejimini savaş ve barış zamanında şeklinde ayrı ayrı düzenlemiştir. Uluslararası hukukta “savaş” teriminin yerini daha geniş bir konsept olan “silahlı çatışma”nın almış olması ve bunun uluslararası nitelikte olan ve olmayan ayrımına tabi tutulması karşısında Sözleşme’deki savaş kavramının ne anlama geldiğinin ortaya konulması gereklidir. Bunun yanında Montrö Boğazlar Sözleşmesi, Milletler Cemiyeti döneminde yürürlüğe girdi. Türkiye’nin, savaş tehdidi altında olduğu değerlendirmesine ilişkin Sözleşme’den doğan haklarını, Milletler Cemiyeti’nin Türkiye’nin aldığı tedbirleri haksız bulmadıkça kullanması öngörülmüştü. Bu makale, Türkiye’nin Birleşmiş Milletler döneminde, özellikle Suriye’deki silahlı çatışmalar karşısında, söz konusu haklarını hangi usul ve esaslar çerçevesinde kullanabileceğini ortaya koymaktadır

A LEGAL ANALYSIS OF THE MONTREUX CONVENTION REGARDING THE TURKISH STRAITS VIS–À–VIS THE ARMED CONFLICTS IN SYRIA

The Syria crisis has made the Turkish straits a current issue once again. As is known, the Montreux Convention regulates the transit regime of the straits separately as in time of peace and in time of war. Since the term “war” has been replaced in international law by the broader concept of “armed conflict” which is subjected to a distinction between international and noninternational, it is necessary to interpret the meaning of the term “war” within the scope of the Convention. Besides, Montreux Convention entered into force in the era of League of Nations. Turkey may made use of the rights conferred upon it by the Convention when considers itself to be threatened with imminent danger of war unless the League of Nations decides the measures taken by Turkey are not justified. This paper has attempted to demonstrate under which procedures and principles Turkey may make use of those rights in the era of United Nations, in particular in the face of the armed conflicts in Syria.
