NORMLARA HAYAT VEREN GERÇEKLİK VE REALİTEYİ DÖNÜŞTÜREN NORMLAR

Geleneksel olarak, hukuk biliminin normatif bir bilim dalı olduğu kabul edilir. Ça- ğımızın bilimsel yargılarına göre ise, doğru bilgi ancak deney ve gözlem yoluyla eldeedilebilir. Bu farklı yaklaşımlar, birbiriyle sadece çelişmezler, aynı zamanda dünyayıfarklı açılardan görmeyi ifade ederler. İşte bu çalışma, anılan paradokstan yola çıkıla- rak yapılan araştırmayı içermektedir. Öncelikle, genel olarak bilgi ve gerçeklik arsında- ki ilişkiler felsefi olarak irdelenmektedir. Burada bilginin soyut metafizik bir alandandeğil, somut maddi dünyadan edinildiği tespit edilmektedir. Aynı yöntemle hukuk bili- mine yaklaşıldığında, hukuk biliminin de esasında ampirik bir zeminde geliştiği ortayaçıkarılmaktadır. Bu bağlamda farklı hukuk teorileri vasıtasıyla, onların normatif gözü- ken çehrelerinin arkasında, çok karmaşık nedensellik bağlarının hüküm sürdüğü ve bubağların hukuk kurallarının oluşumunu tayin ettiği izah edilmektedir. Çalışmada ayrıcanormların pozitif hukukta düzenlendikten sonra, hukuk dogmatiği anlamında norma- tif karakter kazandığı açıklığa kavuşturulmaktadır. Araştırmalar sonucu varılan yargıyagöre, çifte yönlü bir etki söz konusudur. Soyut, felsefi ve normatif ön-kabuller gerçekyaşam düzenini etkilemektedir ve gerçek maddi dünyadan gelen ampirik veriler de,metafizik sanılan normatif alana tesir etmektedir.

Reality Giving Life to Norms and Norms Transforming the Reality

Traditionally, it is admitted that science of law is a normative branch of science. But,according to scientific judgements of our age, the right knowledge can be abtainedsolely by way of observation and experimentation. These different approaches, notonly contradict each other, at the same time, they amount to seeing the world fromdifferent angles. Here, this study embodies conducted research starting from the mentioned paradoxon. At the outset, in general, the relationships between knowl- edge and reality is philosophiecally exsamined. Here, it is secured that the knowledgeis obtained, not from abtract transcendental domain, instead from concrete matter-of- fact world. When approaching to the legal science in the same way, it is uncoveredthat also science of law develeps on an empirical ground. In this context, by means ofdifferent legal theories it is explained that behind the normative outlook of their facesreign very complex causality links and these determine the formation of legal norms.In the study, besides that, it is also clarified that the norms, held in positive law, takea normative strain in the sense of dogmatic law. According to the conclusive result ofresearch, there is a two-way effect. Abstract, philosophical and normative presuppo- sitions affect the order of real life, and ampirical data, comming from the real materialworld, ifluence the normatif area, believed to be metaphysical.
