CİNSEL İSTİSMARLARI AÇIKLAYAN TEORİLERİN SUÇ SORUŞTURMALARI BAĞLAMINDA İRDELENMESİ

İnsanın neden bir çocuğu cinsel yönden istismar ettiği sorusu, sapkın cinsel dav- ranışlar üzerine olan araştırmalara öncülük eden soruların en başında gelir. Çoğu sap- kın davranış şeklinde olduğu gibi, seksüel suçun varlığı ve nedenlerine yönelik çeşitliaçıklamalar vardır. Bu açıklamalardan biri de alanla ilgili teorilerdir. Bu teorilerde cin- sel istismarın oluşumundaki mekanizmanın anlaşılması, değerlendirilmesi ve tedavisüreçlerine katkı sağlaması amaçlanmaktadır. Sapkın cinsel davranış bir başkasınıncinsel dokunulmazlığını ihlal etmesi durumunda suç soruşturmasının konusu halinegelmektedir. Bu nedenle alanda çalışan profesyonellerin cinsel suç soruşturmalarındanasıl bir suç ve suçlu ile karşı karşıya olduklarını bilmeleri gereklidir. Bu çalışmada, cin- sel sapkınlık ve cinsel istismarlarla ilgili teoriler derlenerek suç ve suçlu soruşturmasıbağlamında irdelenmesi hedeflenmiştir. Bu anlamda cinsel suç soruşturması ile ilgilipratiğe dönük çalışmalara katkı sağlaması beklenmektedir.

Evaluating of Sexual Abuse Theories in the Context of Criminal Investigations

The reason people sexually abused as a child questions, deviant sexual behaviorin the beginning of the question who spearheaded the research on income. Mostis in the form of deviant behavior, such as the presence of sexual offenses and hasseveral explanations for why. One of these explanations are related to the field theo- ry. Understanding and evaluating of mechanisms which are responsible for occuring sexual abuse and its treatment processes are aimed in these theories. Once a deviantsexual behaviour violates ones sexual privacy, criminal investigation process starts.Thus the professionals investigating this crime should know how they are confrontedabout sexual crimes and criminals. In this article the theories related deviant sexualbehaviors and sexual abuse were compiled and it is aimed to evaluate these theoriesin context to criminal investigations. Hereby this article is expected to contribute es- pecially practice of criminal investigations related sexual crimes and sexual abuse.
