Avrupa birliği yargılama hukukunda ara önlemler (ihtiyati tedbirler)

Ara önlemler (ihtiyati tebirler) koruması Avrupa Birliği yargılama hukukunun aşamalı olarak daha fazla tanınan bir konusu olmuştur. Ara önlemler AB hukukunda sadece belli konularla sınırlı olmayıp rekabet, kamu ihaleleri, ortak ticaret politikası, tarım gibi birçok konuyla alakalıdır. Bu makalede, öncelikle ara önlemlerin yasal bağlamı ve amaçları, nihai kararın verilmesine kadar geçecek sürede davaya taraf olanların konumunu muhafaza etme işlevi aktarılacaktır. Ara önlemlere ilişkin bazı istatistikler verildikten sonra belli tür davalar çerçevesinde bu tedbirler açıklanacaktır. Avrupa Birliği Adalet Divanının bazı kararları altında ara önlemlere ilişkin kural ve prensipler tartışılacaktır. Bu makale ulusal mahkemeler önünde yapılan ara önlem başvurularını konu alan ve bu konuda temel davalar olan Divanın Factortame, Zuckerfabrik ve Atlanta kararlarını analiz edecektir. Ara önlemlere ilişkin maddi ve usuli koşullar, prosedür türleri, ara önlem türleri, ara önlemlerin esas davaya ilişkin şart ve bağlılığı gibi ara önlemlere özgü bir çok yön irdelenecektir. Bu bağlamda; talep sahibinin iddiasının kabulüne kafi ve muteber delilleri bulunan talep prima facie niteliğini taşıması, başvuru sahibinin çıkarlarına yönelik ağır ve telafi edilemez bir zararın vuku bulmasını engellemek için bir ihtiyaç olması ve başvuru sahibinin menfaatinden daha üstün gelecek davanın diğer tarafının veya başka bir kişinin menfaatinin olmaması gerekir.

Interim measures Under European Union procedural law

Interim measures of protection have gradually become a more accepted feature of procedure in the law of the European Union. It appears that they are not confined to specific areas in EU Law, they concern on different subjects, such as competition, public procurement, common commercial policy, agriculture etc. In this article, first the legal context and purpose of the interim measures will be established, their function of protecting the position of the parties until the final decision is rendered. Having been given some statistics on interim measures they will be explained under certain types of cases. The governing rules and principles of interim measures will be discussed on the bases of the ECJ decisions. This article will analyze the judgements in Factortame, Zuckerfabrik and Atlanta which are the main cases dealing with applications for interim relief in front of the national courts. Various aspects of the interim measures will be highlighted such as the provisional and ancillary nature to the main case, types of measures, types of procedures, substantive and procedural conditions governing their award. In this context, the applicant needs to show that there is a prima facie case and there should be a necessity, as a matter of urgency, in order to avoid serious and irreparable damage to his interests and finally the applicant’s interests are deemed to outweigh those of the opposing or third party (balance of interests).
