AVRUPA BİRLİĞİ CİNSİYET EŞİTLİĞİ İLKESİ PERSPEKTİFİNDEN TÜRK SOSYAL GÜVENLİK SİSTEMİ

Avrupa Birliği’nin bugün ulaştığı hedefleri çerçevesinde cinsiyet eşitliği ilkesi sadece işleyen bir piyasa ekonomisinin gereği olarak değil, temel haklar çerçevesinde dikkate alınmalıdır. Bu kapsamda cinsiyet eşitliği ilkesinin toplumsal alanın tamamında uygulanmasının amaçlandığı görülebilir. Bu çalışmada, 5510 sayılı Sosyal Sigortalar ve Genel Sağlık Sigortası Kanunun ve 4447 sayılı İşsizlik Sigortası Kanunun hükümlerinde cinsiyete dayalı ayrımcılığa yol açabilecek hükümler tespit edilmeye çalışılmış ve AB Ayrımcılık Hukuku çerçevesinde incelenmiştir. Çalışma sonucunda ulaşılan tespit ve öneriler, her iki cinsiyete aynı mesafeden bakılarak ortaya konulmuştur. Ayrıca değişiklik önerilerinin, daha eşitlikçi bir yapıda sosyal güvenlik yardımlarının sunumu için sistemin finansal dengesini olumsuz etkilemeyecek olanlardan başlayarak ve Türk toplumunun değerleri de dikkate alınarak katmanlı bir yapıda uygulanabileceği değerlendirilmiştir.

TURKISH SOCIAL SECURITY SYSTEM FROM THE PERSPECTIVE OF THE EUROPEAN UNION GENDER EQUALITY PRINCIPLE

Within the framework of the objectives of the European Union today, the principle of gender equality should be taken into consideration not as a requirement of a functioning market economy but within the framework of fundamental rights. In that sense, it can be seen that the principle of gender equality is aimed to spread to the whole social sphere. In this study, the provisions of the Social Security and General Health Insurance Law No. 5510 and the Unemployment Insurance Law No. 4447 that could lead to gender discrimination are determined, and they are examined within the framework of the European Union non-discrimination law. Findings and recommendations reached as a result of the study are put forward by looking at both genders from the same distance. Furthermore, to ensure social security benefits in a more egalitarian structure, it is considered that the amendment proposals of the study could be implemented in a layered structure by starting from the ones that would not adversely affect the financial balance of the system and, taking account of the values of Turkish society.
