Türkiye’de Toplu İş Uyuşmazlıklarında Arabuluculuk Sisteminin Etkinliği Üzerine Bir Analiz
Toplu iş uyuşmazlıklarında arabuluculuk süreci, aşağı yukarı tüm endüstri ilişkileri sistemlerinde uzun zamandır mevcut olan ancak farklı nedenlerden dolayı nadir kullanılan bir mekanizmadır. Bu mekanizma, özellikle 2000’lerden itibaren küreselleşme, rekabet gibi dışsal koşulların etkisiyle daha fazla tartışılmaya başlanmıştır. Günümüzde başta Avrupa ülkelerinde olmak üzere, bu mekanizmaların kurumsal ve yasal olarak yeniden ele alınması gibi bir eğilim mevcuttur. Türkiye’de de benzer şekilde oldukça eski olan bu uygulamanın zaman zaman yeniden tasarlanması söz konusu olsa da, benzer eğilimler ile karşılaşılmamaktadır. Bu çalışma, Türkiye’de toplu iş uyuşmazlıklarında tanımlı arabuluculuk sürecine ilişkin 2000-2009 yılları arasında seçilmiş dört işkolundaki verilere dayanmaktadır. ÇSGB’nın resmi arabuluculuk raporları incelenerek oluşturulan veriler, sektörel etkiler, konfederasyonlar arası farklılıklar ve ücrete ilişkin uyuşmazlıkların varlığı gibi faktörler eşliğinde değerlendirilmiştir. Buna göre, Türkiye’de arabuluculuk sürecini etkileyen temel unsurların başında uyuşmazlığın boyutlarını gösteren madde sayısı gelmektedir. Uyuşmazlık madde sayısının fazla olması sürecin başarısını etkilemektedir. Başka önemli bir faktör de, tarafların süreci algılama biçimlerine ilişkin değişkenlerdir ve özellikle sendikaların bağlı olduğu konfederasyonların endüstri ilişkileri sistemine ilişkin eğilimlerinin, arabuluculuk mekanizmasının sonuçlarını etkilediği görülmektedir.
An Analysis on the Effectiveness of Mediation System in Collective Labour Disputes in Turkey
Whereas mediation process defined long established and almost generalized prominent of industrial relation systems has been used rarely. Many of observers identified that this process has transformed by external forces such as globalization and international competition. Also especially in European Countries has tried to reconsider of mediation process in collective bargaining system since beginning of the 2000’s. Mediation processes in collective bargaining has established in Turkish Industrial Relations System similarly and occasionally redesign attempts. Although this kind of efforts, similar trends like European parts are not encountered in Turkey. This study has focused mediation in collective bargaining process in four selective sectors based on official records of 2000-2009 periods. Data created on official roll documents of mediators each dispute and included that structural factor such as sector effects, differences between labour confederations and wage dispute. Quantitative analysis results shown that number of dispute which is sign of conflict size has been leading factor of mediation process. Other factors such as affiliated labour confederation’s tendencies, which is prominent elements of parties’ perception may affect to outcome of mediation mechanism.
