ÖzetAbdeste tesiri bakımından kadınla temas hususunda mezhepler arasında muhtelif görüşler mevcuttur.Nassın farklı yorumlanmasından kaynaklanan bu ihtilafın bir ucunda “mutlak olarak kadınadokunmanın abdesti bozmadığını” iddia eden Hanefîler yer alırken, diğer ucunda “ne sûretteolursa olsun kadına dokunmanın abdesti bozacağını” söyleyen Zâhirîler ve Şâfiîleri görmekteyiz.Mâlikî ve Hanbelî âlimlerin ise öne sürdükleri şehvet şartıyla orta bir görüşü benimsedikleri anlaşılmaktadır.Bu makalede söz konusu mesele mezheplerin yorum ve yaklaşımları sadedinde elealınarak her birinin öne sürdükleri deliller ve karşı delillere yöneltilen tenkitler arz edilmeye çalışılacaktır.Anahtar Kelimeler: Lemsü’n-nisâ, fâhiş mübâşeret, hades, abdest.AbstractIn Islamic law, there are various views concerning the matter of nullification of ablution due totouching women. Among these views, all of whose interpretation is directly from the sources(nass), the Hanafi’s claim that touching a woman does not nullify ablution, no matter what typeof touch it may be. The Zahiri’s and Shafi’s on the other hand claim that any type of touch, nomatter how light or major, nullifies ablution. The Maliki’s and Hanbali’s occupy a middle pathhowever, stipulating the presence of desire in the touch for the nullification of ablution to occur.This article will examine the interpretations of the various schools along with attempting to examineand critique the evidences and counter-evidences.Key Words: Islamic jurisprudence, nullification of ablution, touching women, intercourse, wudû.
