İHALE BEDELİNİ YATIRMAYARAK İHALENİN FESHİNE NEDEN OLAN ALICININ (HİSSEDARIN), TEKLİF ETTİĞİ (ÖDEMEDİĞİ) İHALE BEDELİ İLE SON İHALE BEDELİ ARASINDAKİ FARKTAN SORUMLULUĞUNUN KAPSAMI (İİK. MAD. 133/II)

Kendisine taşınmaz ihale edilen alıcıdan önce en yüksek pey süren kişinin -İİK. mad. 133/I, c:2, 3 uyarınca- teklif ettiği bedelle bu taşınmazı satın alma zorunluluğu yoktur. İhaleye girip, ihale bedelini yatırmayarak ihalenin feshine sebep olan alıcının sorumluluğu mutlaktır. İİK. mad. 133/II uyarınca, ihaleye katılıp daha sonra ihale bedelini yatırmamak suretiyle ihalenin feshine sebep olan tüm alıcılar (ve kefilleri), teklif ettikleri bedel ile son ihale bedeli arasındaki farktan ve diğer zararlardan ve ayrıca temerrüt faizinden müteselsilen sorumludurlar. Katıldığı açık artırma sonunda kendisine yapılan ihalenin bedelini yatırmayan ve İİK. mad. 133 uyarınca ihale kararının icra (satış) müdürü tarafından kaldırılmasına (feshedilmesine) sebebiyet veren kişi "ihale bedelini yatırması için verilen on günlük sürenin bittiği tarihten başlamak üzere ve tamamlayıcı ihalenin ilk ihaleden fazla bedelle yapıldığı tarihe kadar olan" temerrüt faizinden sorumludurlar.

According to Enforcement and Bankruptcy Code Article 133 / I, c: 2, 3, there is no obligation to buy this property which for by the highest hidder before the tendered buyer. The responsibility of the buyer, who has caused the annulment of the tender by the way of entering the auction and not paid the tender price, is absolute. According to Enforcement and Bankruptcy Code Article 133 / II, all buyers (and their guarantors) who terminate the tender through participating in the tender and then not paying the tender price, are joint liable for the difference between the offer price and the final tender price and the other losses plus default interest. At the end of participating auction, the person who non-depositing the tender price and as per Article 133 caused that revoking (annulment) tender decision by enforcement(sales) manager shall be responsible for the default interest “starting from the date on which is given ten days duration for depositing the tender price ends and until the date of making the complementary tender has made with much more price than the first tender.”
