TÜRK FĠKRÎ HAKLAR HUKUKU YAPAY ZEKÂ TARAFINDAN MEYDANA GETĠRĠLEN ESERLERĠ KORUMAK ĠÇĠN HAZIR MI?

Yapay zekâ, Ģimdilerde hayatımızın içinde geniĢ ve önemli bir yer tutuyor. Apple‟ın Siri‟sinden Tesla‟nın sürücüsüz arabasına ve Amazon‟un Alexa‟sına dek yapay zekâ taĢıyan araçlarla donatılmıĢ bir dünyada yaĢıyoruz. Yapay zekâ ile çalıĢan teknolojinin geliĢi hayatımızı giderek artan bir Ģekilde kolaylaĢtırıyor. Yapay zekâ, getirdiği teknolojik yeniliklerle ekonomimizi ve refahımızı da Ģekillendiriyor. Günümüzde yapay zekâ teknolojileri, fikri hakların konusunu oluĢturabilecek birçok fikrî ürün meydana getirebiliyorlar. Bir yapay zekânın eser yaratmadaki kapasitesi ve kabiliyeti, bunlar üzerindeki fikrî mülkiyet haklarına kimin sahip olacağı sorusunu gündeme getiriyor: Yapay zekâ taĢıyan cihazı kiralayan veya programcıyla sözleĢme yapan kullanıcı mı? Programcı mı? Yoksa yapay zekâ cihazının kendisi mi eser sahibi olacaktır? Veya o eser insan ve bilgisayarın ortak bir çalıĢması olarak mı kabul edilecektir? Bu çalıĢmada, bu soruların cevabını Avrupa Birliği (AB), Amerika BirleĢik Devletleri (ABD), BirleĢik Krallık hukuku ve daha kapsamlı olmak üzere Türk hukuku bakımından arayacağız. Özetle bu çalıĢma, Türk fikrî haklar hukuku bakımından bu tarz eserler bakımından bir takım politika önerileri getirmektedir. ÇalıĢmada, özellikle yapay zekâ tarafından meydana getirilen eserlerde, bu teknolojiler etrafındaki ilgili “insan” aktörlerden fikrî hakların sahibi olabilecek olanları tespit etmek için üç-aĢamalı bir test üzerine kurulu bir çözüm önerisi ve model hukuk normları önerilmektedir.

IS TURKISH COPYRIGHT LAW READY TO PROTECT WORKS GENERATED BY ARTIFICIAL INTELLIGENCE?

Artificial intelligence (“AI”) nowadays immensely and importantly infiltrates our lives. From Apple‟s Siri to Tesla‟s auto-driving car and Amazon‟s Alexa, we live in a world of AI goods. The advent of AI-powered technologies increasingly affects people‟s life across the globe. With its technological advances, AI also shapes our economy and welfare. Current AI Technologies can produce many works that might be subject of copyright law. An AI device‟s ability to generate works raises the question of who will own the intellectual property rights over those works. Will it be the author who hires or contracts with the AI device programmer? Will it be the programmer? Or will it be the AI device itself? Or will it be a joint work? In this article, we seek answers to these questions under European Union (EU), United States of America (US), United Kingdom (UK) laws and more comprehensively under Turkish law. In short, this study makes policy proposals for Turkish copyright law. It particularly offers a proposal of a solution based on a three-step test to single out the human authors(s) from the relevant actors around the AI device and model legal norms for AI-generated works.
