DİJİTAL TEK PAZARDA TELİF HAKKI VE BAĞLANTILI HAKLAR YÖNERGESİ İLE BERABERİNDE GETİRDİĞİ TARTIŞMALAR

2019/790 sayılı Dijital Tek Pazarda Telif Hakkı ve Bağlantılı Haklar Yönergesi, geniş tepki ve tartışmalara rağmen 17 Mayıs 2019 tarihinde AB Resmi Gazetesi’nde yayınlanmış ve 7 Haziran 2019 tarihinde yürürlüğe girmiştir. AB üye ülkelerinin 7 Haziran 2021 tarihine kadar ulusal mevzuatlarını Yönerge ile uyumlu hale getirmeleri gerekmektedir. Bu itibarla, çalışmada öncelikle dijital tek pazar kavram itibariyle ortaya koyulmaya çalışılacaktır. Ardından, Yönerge’nin amacı ve geniş tartışmaları beraberinde getiren basın yayımcısına tanınan komşu hak ile çevrimiçi içerik paylaşım platformlarının sorumluluğunu düzenleyen maddelerin öngörülen uygulaması ve tartışmalı noktaları detaylıca incelenecektir. Son olarak, üye ülkelerin Yönerge’ye karşı görüşleri ve Polonya tarafından Avrupa Adalet Divanı’na yapılan başvuru ortaya koyulacaktır.

DIRECTIVE OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL ON COPYRIGHT AND RELATED RIGHTS IN THE DIGITAL SINGLE MARKET AND ASSOCIATED DEBATES

Despite extensive debates, the Directive 2019/790 of the European Parliament and of the Council on Copyright and Related Rights in the Digital Single Market (“Directive”) was published in the Official Journal of the European Union on May 17, 2019 and entered into force on June 7, 2019. European Union member states are required to translate and implement the Directive into national laws by June 2, 2021. This paper firstly focuses on the definition of the digital single market. Secondly, this paper discusses the aim of the Directive and analyzes the potential implication and problems regarding the press publishers’ rights and the new form of responsibility set out for online content sharing service providers. Lastly, this paper explains the European Union member states’ stances towards the Directive and Poland’s application before the European Court of Justice.
