Uluslararası Çalışma Örgütü (ILO) Bağlamında Kamu Görevlilerinin Grevi de İçeren Toplu Eylem Hakkı

Bu çalışmada uluslararası çalışma normları bağlamında grevi de içeren toplu eylem hakkından faydalanma konusunda kamu görevlilerinin durumu ele alınacaktır. Kamu görevlilerinin toplu eylem hakkının kullanımının ülkelerin kendi mevzuatları uyarınca ve bazı koşullarla birlikte sınırlandığı ya da tamamen engellendiği örnekler söz konusudur. Bu sınırlama ve engellemenin asgari seviyede kalması ve kamu görevlilerinin tümüne yayılmaması için Uluslararası Çalışma Örgütü(ILO)’nün denetim organları, Birleşmiş Milletler Belgelerinde ön görülen denetim mekanizmaları, İnsan Hakları Avrupa Sözleşmesi (İHAS) ve denetim sistemi, Avrupa Sosyal Şartı ve Sosyal Haklar Avrupa Komitesi tarafından bu konuda zengin bir içtihat ortaya çıkmıştır. Ancak bu zengin içtihadın oluşumunda ILO’nun rolü diğerlerine göre daha önemli ve büyüktür. Bu nedenle bu çalışmanın özellikle odak noktasını ILO denetim mekanizmalarının vermiş olduğu kararlar oluşturmaktadır.

Collective Action Rights Including Right to Strike In Terms of International Labour Organization

In this study, the situation of public officials/civil servants will be dealt with in the context of international labor norms, in order to make use of the right to collective action including strike action. There are examples in which the use of the right to collective action by public officials/civil servants is limited or completely obstructed with certain conditions. In order for this limitation and obstacles to remain at the minimum level and not to be spread over the categories of all public officials; the supervisory bodies of the International Labour Organization, the supervision mechanisms envisaged in the United Nations Document, the European Convention on Human Rights and the control system the European Social Charter and the European Committee for Social Rights have developed a rich legal precedent. However, the role of the International Labor Organization is great in the formation of this rich legal precedent. The focus of this study is the decisions made by the International Labor Organization’s supervisory mechanisms.
