ADALET DİVANI’NIN 2/15 SAYILI GÖRÜŞÜ’NÜN AVRUPA BİRLİĞİ’NİN YENİ YATIRIM ANTLAŞMALARINI NASIL ŞEKİLLENDİRECEĞİNE İLİŞKİN BİR DEĞERLENDİRME

Gerek Lizbon Antlaşmasıyla Avrupa Birliği’nin münhasır yetkilerinin kapsamının genişlemesi, gerekse Dünya’da daha geniş kapsamlı Yeni Nesil Ticaret Antlaşmalarının görüşülmeye başlaması Avrupa Birliği Hukuku kapsamında bu alandaki yetkilerin Avrupa Birliği’ne mi,  üye ülkelere mi, ya da iki grup arasında paylaşılan yetkilere mi dahil olup olmadığı konusu tartışmalı hale gelmiştir.  Çalışmada “Avrupa Birliği-Singapur arasındaki Serbest Ticaret Antlaşması” kapsamında bu konuda verilen Adalet Divanının 2/15 sayılı Görüşü incelenecek, Avrupa Birliği hukuku dinamikleri de dikkate alınarak önemli konulara dikkat çekilecektir.

OPINION 2/15 OF THE COURT AND HOW IT WILL AFFECT THE NEW EUROPEAN UNION INVESTMENT AGREEMENTS

Competences in the European Union law such as exclusive European Union competences, exclusive member state competences or shared competences became a very disputed area after the Lisbon Treaty increased the scope of the exclusive competences of the European Union in addition to the wider scope New General Trade Agreements.  The paper aims to discuss these issues and focus on important topics with reference to the Opinion 2/15 of the Court on the “European Union-Singapore Free Trade Agreement” with special emphasis on European Union law features.
