HEKİMİN BİLGİLENDİRME YÜKÜMLÜLÜĞÜ

Tıbbi müdahalenin hukuka uygunluğu için, hastanın müdahale ve sonuçları hakkında yeterince bilgilendirilmiş ve müdahale için rızasının alınmış olması gerekmektedir. Hastanın rızası, hasta bakımından beden ve ruh bütünlüğün sağlanması ve kendi geleceğini belirleme hakkının doğal sonucudur. Hastanın sağlığını ve yaşamını ilgilendiren bir konuda karar vermesi, hastalığı ve tedavi için uygulanabilecek yöntemler hakkında gerekli ve yeterli düzeyde bilgiye sahip olması ile mümkündür. Ancak bu koşulla hastanın tıbbi müdahaleye gösterdiği rıza bir anlam ifade edecek ve rıza, tıbbi müdahalenin hukuka uygunluğunu sağlayabilecektir. Hekim bir yandan hastanın tıbbi yönden yararını gözetirken, diğer yandan haklarını kullanma imkânı tanımakla yükümlüdür. Bu bilgilendirmeyi yaparken, hastanın sosyal, kültürel koşulları dikkate alınmalıdır. Ancak, hekim hastasının sağlığını ve yaşamını ilgilendiren kararı vermesi için, hastalığı ve tedavisi için uygulanabilecek yöntemler hakkında gerekli ve yeterli düzeyde bilgiyi, onun sosyal, kültürel koşullarını da dikkate alarak vermekle yükümlü tutulurken ve bu yükümlülüğünü yerine getirdiğine dair ispat külfeti de hekime yüklenmiş iken, bu yükümlülüklerini yerine getirebileceği koşulların da sağlanması önemlidir. Aksi takdirde defansif hekimlik uygulaması ile yine hasta zarar görecektir.

MEDICAL DOCTOR’S OBLIGATION OF NOTIFICATION

In order to justify a medical intervention, patients are required to be informed adequately about the medical intervention and its results, and their consents for the intervention need to be obtained. The consent of a patient is the natural result of the right to maintain the physical and mental health and right to determine one’s future. In order for a patient to decide on a subject related to his health and life is possible only when the patient has the necessary and adequate knowledge about the procedure for his disease and treatment. Only in these circumstances the patient’s consent for the medical intervention shall make sense and the consent would justify the medical intervention. The medic is obliged to care about the patient’s health and enable them to exercise their rights. While medics are fulfilling their obligation of notification, they need to consider patient’s social and cultural condition. Medical doctors are required to consider the necessary and adequate information about the procedures for the patient’s treatment and also the patient’s social and cultural condition while they are to make a decision concerning with the patient’s health and life. On the other hand, the burden of proof related to this obligation of notification is carried by the doctors and they are required to provide the conditions to fulfil their obligation. Otherwise, the patient would be the one to get harmed because of the defensive doctor practise.
