BİR ULUSLARARASI HUKUK MÜESSESESİ OLARAK ULUSLARARASI ÖRGÜTLER ARASINDA ARDILLIK

Uluslararası örgütler hukukunun en önemli merak uyandıran alanlarından biri devletler arasındaki ardıllık olmaktadır. Devletlerle mukayese edilirken her ne kadar hukuk kişiliklerinin tanınması yeni bir fenomen olsa da uluslararası örgütlerin uluslararası hukuk düzleminde sınırlı faaliyet ve hizmet görmeleri söz konusudur. Bunu yaparken de, uluslararası hukuku kullanmakta ve bu alışve-rişin bir sonucu olarak aralarında devletlerin ardıllığı kuralları da dâhil olmak üzere uluslararası hukuk kurallarının ihtiyaç ve yeteneklerine hizmet edecek şekilde uyarlanmaları gerekmektedir. Çok karmaşık yapısı sebebiyle devlet ardıllığı uluslararası hukukun en belirsiz alanı olarak mütalâa edilmektedir. Böylelikle, bu kadar karmaşık bir alanı özünde çok geniş bir çalışmayı zarurî kılan bir başka alana taşımanın çok zor bir iş olduğu farz edilebilecektir. Ancak, bu kısa makalede bu denli geniş bir çalışma söz konusu edilmeyecektir. Bu bağ-lamda, bu kısa çalışmada bizim amacımız sadece uluslararası örgütler arasında ardıllığın var olduğunun ve uluslararası örgütler hukukunun bir konusu olarak tanınması için kısaca içeriğinin ve hukukî statüsünün ortaya konulmasından ibarettir.
