Eş cinsel birliktelikler ve bunların kanunlar ihtilafı hukukunda düzenlenişi

Eş cinsellerin, giderek artan bir biçimde birlikte yaşama ve bu yaşamın gerektirdiği hak ve yükümlülüklere sahip olma taleplerini dikkate alan modern devletler, söz konusu birlikteliklere belli oranlarda hukukî etki tanımıştır. Bugün dünyada, eş cinsel birliktelikler; evlilik, kayıtlı birliktelik veya medenî birliktelik şeklinde resmîleşmektedir. Evliliği, geleneksel bir biçimde kabul eden ve ancak farklı cinslerdeki kişilerin yararlanabileceği bir kurum olarak gören devletler, birlikteliklerine hak ve yükümlülük tanınmasını isteyen eş cinsellere eşitsizlik yapmamak amacıyla kayıtlı birliktelik statüsünü getirmiştir. Bugün devletlerin, eş cinsel birliktelikleri düzenlerken, maddî hukuklarında olduğu kadar, kanunlar ihtilâfı hukuklarında da farklı yaklaşımları benimsemesi, sınır aşıcı durumlarda ortaya ihtilâflı ve karmaşık durumların çıkmasına yol açmaktadır.

Same sex relations and the relevant regulations in the conflict of laws

Certain modern states, taking into consideration the increasing number of demands of homosexual couples that wish to cohabitate together and gain rights and responsibilities resulting from such cohabitation, legally regulate this kind of cohabitation in various manners. Today, same-sex relations are classified as same-sex marriages, registered partnerships or marital cohabitations. States having the traditional concept of marriage between women and men, in order to meet the demands of homosexual couples for a recognized legal status, have preferred to use to the “registered partnership” classification. Because of the fact that the States’ approaches differ to a large extent, not only in their substantial laws but also in their private international laws, there may be disputed and complicated cross-border situations to be faced by the States.
