Cinsel İstismar Mağduru Çocuk İfadelerinin Ölçüt Bazlı İçerik Analizi: “CBCA” (Criteria-Based Content Analysis)

Hem dilbilim (özellikle söylem çözümlemesi), hem de kriminoloji biliminin çalışma alanına giren, cinsel suç mağduru çocuk ifadelerinin gerçekliğinin ve yaşanmışlığının analizinin amaçlandığı bu çalışmada, gerçekten yaşanmış cinsel şiddeti anlatan ifadelerin, uydurma ifadelerden nicel ve nitel olarak farklı olup olmadığı ve bir ifadenin içeriğinin gerçekten yaşanmış kısımlarını uydurma kısımlarından ayırmanın mümkün olup olmadığı sorularına cevap aranmıştır. Çalışmanın bütüncesini, Profesör Hubert Van Gijseghem (1994) tarafından gerçekleştirilen «Impact de diverses variables de l’abus sexuel sur la qualité de la déclaration de l’enfant tel que déterminée par la méthode SVA (Statement Validity Analysis) » isimli çalışmada kullanılan bütünceden seçilen 10 cinsel suç mağduru çocuk ifadesi oluşturmuştur. “CBCA” (Criteria-Based Content Analysis) metodu kullanılarak çözümlenen 10 ifadede, CBCA ölçütlerinin, ifadelerin gerçekten yaşanmış olduğunu gösterme üzerine %90 oranında etkili olduğu saptanmıştır. Ayrıca ifadelerin gerçeklik koşulu için “en az 8 ölçüt bulunması” yaklaşımının geçerli olduğu belirlenmiştir. Çalışmanın sonucunda, çocukların cinsel istismarına dair vakaların çoğunda elde kalan tek veri olan mağdurun ifadesinin, mutlaka uzmanlar tarafından analiz edilerek geçerliliğinin değerlendirilmesi gerektiği sonucuna varılmıştır.

CRITERIA-BASED CONTENT ANALYSIS (CBCA) OF CHILD VICTIMS OF SEXUAL ABUSE

In this research, which was at the crossroads of linguistics and criminology, it was aimed to analyze the validity and the actuality of the infant victims’ statements; Solutions to the problems of whether the statements that sexual abuse really happened were different from the fictitious statements in terms of quantity and quality or it was possible to distinguish the really experienced parts from the fictitious parts were sought. The corpus of the research constituted the statements of 10 infant victims of sexually abused, who were chosen from the corpus used in the research called « Impact de diverses variables de l’abus sexuel sur la qualité de la déclaration de l’enfant tel que déterminée par la méthode SVA (Statement Validity Analysis) » carried out by Dr. Hubert Van Gijseghem and his team in 1994. In 10 statements analyzed with the criteria of “CBCA” (Criteria-Based Content Analysis), it was shown that CBCA was 90% effective to demonstrate if the statements really happened. Furthermore it was determined that it was necessary to maintain at least 8 criteria for the validity of the statements. In the end of the research, it was concluded that the victim statements-the sole data that could be obtained in most cases -had vital importance, and they should be analyzed by the experts if they were valid or not.
