BİR KİTLE İMHA SİLAHI OLARAK NÜKLEER SİLAHLARIN YASAKLANMASINA YÖNELİK ÇABALAR

Çalışma temel olarak nükleer silahların yasaklanmasına yönelik hukuksal çabalar konusundadır. Bu çerçevede, öncelikle nükleer silah teknolojisinin tarihsel gelişimiyle nükleer devletlerin bu silahların başka devletler tarafından üretilmesini engelleme girişimleri ele alınmakta ve silahsızlanmayı önermektense yeni nükleer silahların yayılması ve yeni nükleer devletlerin oluşmasına odaklanan nükleer devletlerin bu tutumunun günümüzde de sürdürdüğü ileri sürülmektedir. Bu çalışmanın temel savıysa, hem de UAD’nin 1996’da verdiği “belirsizlik/kesin bir şey söylenemez” danışma görüşüne rağmen, nükleer silahların yasaklanması ve topyekûn silahsızlanma görüşünün aslında hukuken oldukça güçlü bir şekilde savunulabilir olduğudur. Devlet uygulaması alanında bu yöndeki en güncel ve güçlü verilerden biriyse, artık coğrafi olarak dünyanın çok önemli bir kısmını kapsayan nükleer silahlardan arındırılmış bölge uygulamalarıdır. Öte yandan, genel bir kuralın oluştuğunun kesin bir şekilde söylenmesinin önündeki neredeyse tek engelse, silahsızlanma çağrıları yapan nükleer devletlerdir
