Sri Lanka ve Koruma Sorumluluğu

“Koruma sorumluluğu” kavramı soykırım, insanlığa karşı suçlar, savaş suçları, etnik temizlik gibi uluslararası hukukun en ağır ihlalleri karşısında devletlerin vatandaşlarını koruma konusunda öncelikli sorumluluğu esasına dayanır. Kavramın içeriği itibarıyla uluslararası toplumun sorumluluğu ise devletlerin bu görevi yerine getirmediği bütün durumlarda söz konusudur. Sri Lanka‟da özellikle 2009 yılının ilk yarısında Sri Lanka devleti tarafından Tamil Kaplanları ile mücadele gerekçesiyle bölgede yaşayan Tamil Halkına yönelik topyekûn bir savaş başlatılmıştır. Bunun sonucunda binlerce insan öldürülmüş ve yerinden yurdundan edilmiştir. Bu anlamda Sri Lanka örneği hem devlet hem de uluslararası toplum nezdinde koruma sorumluluğu açısından çifte bir başarısızlık örneğidir. Bu da koruma sorumluluğu açısından en azından uluslararası toplum bağlamında ortada politik bir kararlılık bulunmadığı sürece bu ve benzeri olayların yaşanacağını göstermektedir.

Sri Lanka and Responsibility to Protect

The „‟Responsibility to Protect‟‟ concept is based on the governments‟ primary responsibility to protect their citizens against gross violations of international law such as genocides, crimes against humanity, war crimes and ethnic cleansing. The responsibility of international community, according to the context of the concept, comes into prominence as the governments fail to fulfill this duty. A full scale war was waged against Tamil community by Sri Lanka Government, particularly in the first half of 2009, on account of fighting against Tigers of Tamil. Consequently thousands of people were either killed or de-territorialized. In this context, the case of Sri Lanka is an instance of double failure in terms of responsibility of providing protection both for the government and international community. Thus, it is indicated by this case that, such events will always occur in the absence of a political determination in terms of responsibility to provide protection, at least in the eye of international community.
