Türkiye’de İşveren Sendikacılığının Tarihi Seyri

Türkiye’de 1947 yılında ilk Sendikalar Kanunu’nun kabul edilmesi işçi sendikaları ile beraber işveren sendikalarının da kurulmalarının yolunu açmıştır. Ancak 1961 yılına kadar münferit birkaç örgütlenme dışında bir işveren sendikalaşmasından söz edilemez.Türkiye’de 1961 yılında sosyal ve ekonomik haklara vurgu yapan yeni bir Anayasanın kabul edilmesiyle işverenler teşkilatlanma ihtiyacı duymaya başlamıştır. 1962 yılında Türkiye İşveren SendikalarıKonfederasyonunun kurulması ve 1963 yılında Sendikalar Kanunu ile Toplu Sözleşme, Grev ve Lokavt Kanununun kabul edilmesi işverenlerin teşkilatlanmalarına hız kazandırmıştır. 1982 yılında yeni bir Anayasanın kabulü ve 1983 yılında söz konusu kanunların değişmesine kadar işveren sendikası sayısı Cumhuriyet Tarihinin en yüksek seviyesine çıkmıştır. Ancak 1983 yılından sonra bu sayı yarıya kadar düşmüş, 2010 yılı Anayasa değişikliği sonrası 2012 yılındaki mevzuat değişikliğinden sonra da bu seviyeleri korumuştur.1983 yılından sonra işverenlerin daha az savunma ihtiyacı içinde olmaları hem sayılarının az olmasına hem de sayısal çokluk yerine işlevsellik üzerine kurgulu faaliyet göstermelerine yol açmış görünmektedir.

The Process of Employer’s Organizations in Turkey

The adoption of the first Trade Union Act in Turkey in 1947 opened the way for the establishment of trade unions as well as employers' organizations. Until 1961, however, there is not so much employer unionization to speak of other than a few individual organizations.In Turkey in the year of 1961, with the adoption of a new Constitution, which emphasized social and economic rights, employers began to need to organize. The establishment of the Turkish Confederation of Employer Associations in 1962 and the adoption of the Trade Unions Act and the Collective Agreement, and the Strike and Lockout Law in 1963; accelerated the organization of employers. Until the adoption of a new Constitution in 1982 and the change of the related laws in 1983, the number of employers' organizations reached the highest level in the Republican History. But after 1983, this number has fallen by half; following the amendment of the Constitution in 2010, and after the revision of the legislation in 2012, it has maintained these levels.After 1983, it seems that, employers' less need for defense resulted in both the unions to be in small numbers, and instead of numerical multiplicity, their fictional activity to be on functionality
