Kosova’nın Bağımsızlığının Self Determinasyon Çerçevesinde Analizi

Bu çalışmanın amacı, eski Yugoslavya’yı oluşturan Federe Devletlerden Sırbistan içerisinde özerk bölge konumunda bulunan Kosova’nın tek yanlı bir kararla 17 Şubat 2008’de bağımsızlık ilan etmesinin self determinasyon hakkı ile çelişip çelişmediğini incelemektir. Nüfusun büyük çoğunluğunun Arnavutların oluşturduğu Kosova, Tito iktidarı döneminde ve sonrasında baskı altında tutulmuş, temel hak ve özgürlükleri sınırlandırılmıştır. 1989 yılında özerk bölge statüsü Sırbistan yönetimi tarafından ortadan kaldırıldıktan sonra Kosova’da polis devleti uygulamaları ve şiddet hareketleri artmıştır. Bir soykırım yaşanmaması için NATO tarafından Kosova’ya hava operasyonu düzenlenmiş, ardından BM Güvenlik Konseyi’nin 1244 sayılı kararıyla bölgede uluslararası yönetim kurulmuştur. Sekiz yıl süren BM ve NATO yönetiminin ardından Kosova, Martti Ahtisaari Planı çerçevesinde bağımsızlık ilan etmiştir. Bu karar, her ne kadar uluslararası hukuk bakımından sorunlu ise de, meşruiyetini 1244 sayılı karardan almaktadır. Kosova halkına karşı Sırbistan yönetiminin soykırım boyutlarına ulaşan şiddet hareketleri bağımsızlık kararının geniş biçimde desteklenmesine neden olmuştur. Devletlerin sınırlarının değişmezliği ve toprak bütünlüğü ilkesi ile uyumlu olmamasına rağmen Priştina Parlamentosunun bağımsızlık kararı, self determinasyon uygulaması olarak kabul edilebilir. Nitekim 2015 yılı sonu itibariyle 111 devlet Kosova’nın bağımsızlığını tanımıştır

The Analysis of Kosovo's Independence within the Framework of Self-Determination

This study aims to display whether or not the declaration of independence with a unilateral decision on February 17th 2008 by Kosova which was in a position of the autonomous region in Serbia among Federated States in the former Yugoslavia conflicts with the right of self determination. The population of Kosova, majority of the people are Albanian were kept under pressure and fundamental rights and freedoms were restricted during and after Tito’s ruling period. Upon the elimination of Kosovo's autonomous status by Serbia's leadership in 1989, practices of police state and acts of violence, reaching the size of genocide has increased in the region. In order to prevent a possible genocide, air operations in Kosovo were organized by NATO, then with the decision of the UN Security Council Resolution No. 1244 an international administration in the region were established. After the eight year UN and NATO administration, Kosovo has declared independence within the framework of Martti Ahtisaari Plan. Although this decision is problematic in terms of international law, its legitimacy is based on the UN Security Council decision No. 1244.The use of violence against the population of Kosovo by the Serbian government and its genocidal dimension has led to the fact that the independence decision has been widely supported. Although it is not compatible with the principles of immutability of borders and territorial integrity of states, the independence decision of the Pristina Parliament can be considered as the application of the self-determination. Indeed, as the end of 2015, 111 states have recognized Kosovo's independence.
