SURİYELİ MÜLTECİLER ÖZELİNDE AVRUPA BİRLİĞİ ORTAK GÖÇ POLİTİKASI VE BİRLİK İLE ÜYE DEVLETLER ARASINDA EGEMENLİK TARTIŞMALARI

Göç; insanlık tarihinin en başından itibaren var olan ve olmaya devam edecek bir olgudur. Günümüzde ise dünyanın gündeminde olan düzensiz göç dalgası, Orta Doğu ve Kuzey Afrika (MENA) Bölgesi’nde 2010 yılında başlayan ve Arap Baharı olarak adlandırılan olayların etkisi ile tetiklenmiştir. Bu bölgelerde yaşayan insanlar canlarını kurtarmak ve daha iyi koşullarda insanca yaşamak umuduyla vatanlarını terk etmekte ve düzensiz göç hareketleri yaratmaktadır. Bu noktada, konumuz ülkemiz ve Avrupa Birliği açısından en önemli ve acil meselelerin başında, Suriye’de başlayan ve devam eden iç savaştan kaçarak canlarını kurtarmaya çalışan insanların durumu gelmektedir. Çaresiz insanların durumu, hem ülkemiz hem de insanlık adına bir sorun teşkil ederken aynı zamanda değişik bir bakış açısıyla Avrupa Birliği’nin göç politikalarının da yeniden sınanması anlamına gelmektedir. Çünkü Avrupa Birliği, bir yandan üye devletlerle birlikte ortak bir göç politikası oturtmaya çalışırken diğer yandan da bilhassa mültecilerin sınır girişi yaptığı Yunanistan, İtalya, Macaristan ve Bulgaristan gibi ülkelerin göç politikalarıyla bile bağdaşmayan insanlık dışı sert ulusal uygulamaları ile uğraşmaktadır. Özellikle Bulgaristan ve Macaristan, Suriyeli göçmenlere karşı sert önlemler alırken var olan kriz karşısında alınacak önlemlerin ulusal egemenlik çerçevesinde olması gerektiğini iddia etmektedir. Bu iddia da aslında uluslararası göç politikaları bağlamında AB’nin ulus üstü yetkisinin ortak göç politikası bağlamında zorlanması demektir. Buradan hareketle bu çalışma Avrupa Birliği ortak göç politikalarının geleceğine ve bu konudaki ulus üstü yetkisinin sürdürülebilirliğine, Suriyeli mülteciler sorunu özelinde ışık tutmayı amaçlamaktadır.

THE COMMON MIGRATION POLICY OF THE EUROPEAN UNION IN THE LIGHT OF SYRIAN REFUGEES AND SOVEREIGNTY DEBATES BETWEEN THE UNION AND THE MEMBER STATES

Migration is a phenomenon that has existed from the very beginning of human history. Today, the irregular migration inflow that is on the agenda of the world is triggered by the events that started in the Middle East and North Africa (MENA) region in 2010 and called the Arab Spring. The people living in these regions are creating irregular migratory movements and abandoning their homeland, hoping to save their lives and live humanely on better conditions. At that point, the most important and urgent issues in terms of our country and the European Union are the situation of people who are escaping the ongoing civil war to save their lives. The situation of these desperate people constitutes a problem both for our country and for humanity, and at the same time, it means that the immigration policies of the European Union are tested again with a different point of view. Since while the European Union is trying to implement and set up a common immigration policy also, the Union deals with national practices of countries, such as Greece, Italy, Hungary and Bulgaria. Especially Bulgaria and Hungary claim that they would take the precautions against the ongoing crisis within the national sovereignty. This is in fact a challenge in the context of the common immigration policy and the EU's supranationality. From this point of view, this study intends to shed light on the future the EU’s common migration policies and on the sustainability of the supranationality in the light of Syrian refugees.
