Avrupa İnsan Hakları Mahkemesi’nin Bir Kararı Vesilesiyle Devlet Mallarının Haczedilmezliği Kuralı Üzerine Düşünceler

İİK m. 82, I/1 uyarınca devlet malları haczedilemez. Bu kural uygulamada borçlu devlet kurumunun borcu ödemekten kaçınmak için sıklıkla kullanılmakta ve bu durum da şikâyetlere yol açmaktadır. Anayasa Mahkemesi söz konusu kuralın anayasaya aykırı olmadığı yönünde bir karar vermiştir. Buna karşılık alacağını alamayan bir limited şirketin başvurusu üzerine Avrupa İnsan Hakları Mahkemesi yapmış olduğu inceleme sonucunda bu tip bir uygulamanın Ek 1 Numaralı Protokolün 1. maddesinde düzenlenmiş bulunan mülkiyet hakkının bir ihlali olduğu sonucuna varmıştır. İİK m. 82, I/1’de düzenlenmiş bulunan devlet mallarının haczedilmezliği kuralı anayasaya aykırı olup bu konuda yeni bir düzenlemeye gidilmesi zorunludur.

On The Pr omting Of The Decision Of The Eur opean Court Of Hum an Rights  Considerations About The Rule Of State Pr operties’ Being Non-Distrainable

State properties cannot be distrained as per the Article 82/I,1 of the Code of Execution and Bankruptcy. This rule is frequently being used in practice by the debtor governmental institutions in order to refrain from payment of the debts and causes objections to occur. The Constitutional Court has decided that this rule is not unconstitutional. On the other hand at the end of the enquiry made upon the recourse of a limited liability company which could not collect its credit, the European Court of Human Rights has concluded that such an application violates the right of property regulated in the Article 1 of the Appendix Protocol No. 1. The abovementioned rule of state properties’ being non-distrainable is unconstitutional and this matter has to be re-regulated.
