Anayasa Mahkemesinin Kamu Görevlilerinin Kişisel Sorumluluğu Konusundaki Yaklaşımının Muhtemel Sonuçları

İdari Yargılama Usulü Kanununun 28/4. maddesi, idari yargı kararını kasten yerine getirmeyen kamu görevlisine karşı tazminat davası açılabileceğini öngörmektedir. Bu kuralın Anayasanın 129/5 maddesine aykırı olduğu ileri sürülmüştür. Ancak Anayasa Mahkemesi, bu kuralı Anayasaya uygun bulmuştur. Anayasa Mahkemesine göre, yargı kararını uygulamama konusunda bir yetkisi olmayan kamu görevlisinin kararı uygulamaması durumunda kişisel sorumluluğunun kabul edilmesi gerekir. Anayasa Mahkemesinin bu yaklaşımı, yalnızca yargı kararlarının uygulanmaması durumuyla sınırlı kalmayacak biçimde genel olarak idarenin sorumluluğu algısı üzerinde sonuç doğuracaktır. Mahkemenin kararı idarenin hukuka aykırı işlem ve eylemleri nedeniyle, idarenin hizmet kusuruna dayanan sorumluluğunu daraltan ve bunun yerine kamu görevlilerinin kişisel kusura dayanan şahsi sorumluluğunu kabul eden bir anlayışı yansıtmaktadır.

Pr obable Consequences of the Constitutional Court ’s Attitude Towards the Personal Liability of Public Servants

According to the article 28/4 of “Procedure of Administrative Justice Act”, a compensation action might be brought against the public servant who deliberately failed to fulfill the requirements of the administrative courts’ decisions. Although it is alleged that this rule is in contradiction with the article 129/5 of the Constitution, the Constitutional Court held that it is compatible with the Constitution’s relevant articles. The Court stated that, public servants do not have the power not to fulfill court decisions and therefore this non-fulfillment must be regarded as public servant’s personal fault. The Court’s attitude could not be limited to the case of non-fulfillment of court decisions and shall have its impact on the general perception of administrative liability. The Court’s decision reflects a vision that limits the scope of administrative liability based on service-connected fault for unlawful acts and actions, replacing it with the personal liability based on the personal fault of public servants.
