Türkiye ile Avrupa Birliği Arasındaki Geri Kabul Anlaşmasının Hukuki Yönden Analizi

Türkiye ile Avrupa Birliği “AB” , düzensiz göçle daha etkin mücadele etmek adına, “Türkiye Cumhuriyeti ile Avrupa Birliği Arasında İzinsiz İkamet Eden Kişilerin Geri Kabulüne İlişkin Anlaşma”yı “GKA” 16 Aralık 2013’te imzalarken; GKA, 1 Ekim 2014 itibarıyla yürürlüğe girmiştir. GKA, özünde, karşılıklılık temelinde, Türkiye veya AB üyesi bir devlet açısından düzensiz göçmen olan vatandaş, üçüncü ülke vatandaşı veya vatansız kişinin geri kabulü veya transit geçişi ile ilgili koşulları, esasları ve usulleri tespit etmektedir. İşte bu çalışma, gerek AB ve üyesi devletler gerek Türkiye hukuk düzeninin yeni kaynağı olan GKA’yı hukuki yönden analiz etmektedir

The Legal Analysis of Readmission Agreement Between Turkey and European Union

In order to combat irregular immigration more effectively, Turkey and European Union “EU” signed the “Agreement between Republic of Turkey and the European Union on the Readmission of Persons Residing without Authorisation” “RA” in 16 December 2013 and RA entered into force in 1 October 2014. In sum, RA determines the conditions, essentials and procedure related to the readmission or transit of nationals, third country nationals and stateless persons who are irregular migrants in relation to Turkey or EU Member States. This paper, hence, analyses RA, which is a new source of the legal order of the EU and its Member States on the one hand, and Turkey on the other hand, from a legal point of view
