DÜNYA TİCARET ÖRGÜTÜ UYUŞMAZLIKLARIN ÇÖZÜM SİSTEMİ VE ÇİN’İN TARAF OLDUĞU UYUŞMAZLIKLAR

Dünya Ticaret Örgütü (DTÖ), uluslararası ticaretin kurallarını, işleyişini ve usullerini düzenleyen kurumsal ve hukuki yapıya sahip bir uluslararası sistemdir. DTÖ kuralları, Gümrük Tarifeleri ve Ticaret Genel Anlaşması (GATT) kurallarına nazaran daha ayrıntılı ve kapsamlıdır. Anlaşma niteliğindeki GATT çerçevesinde gerçekleştirilen DTÖ, üye devletlerarasındaki ticari uyuşmazlıkların çözümlenmesini sağlamak amacıyla bir uyuşmazlık çözüm sistemi oluşturmuştur. Bu sistem, uzun süre sonucunda kazanılan deneyimlerden elde edilmiş olan ve uyuşmazlıkların çözümüne ilişkin kuralları ve yöntemleri tespit eden Uyuşmazlıklar Çözümüne Dair Mutabakat Metnine (UÇMM) dayanmaktadır. UÇMM; DTÖ Anlaşması, GATT 1994 sistemi, diğer tüm Mal Ticareti Anlaşmaları, Hizmetler Ticareti Genel Anlaşması ve Ticaretle Bağlantılı Fikri Mülkiyet Hakları Anlaşması ile ilgili doğabilecek uyuşmazlıkların çözümüne ilişkin kural ve yöntemleri kapsamakladır. Çalışmamızda, uyuşmazlık çözüm sistemi ve Çinin söz konusu sistem içerisinde taraf olduğu uyuşmazlıklar incelenmeye ve değerlendirilmeye çalışılmıştır.

WORLD TRADE ORGANIZATION DISPUTE SETTLEMENT SYSTEM AND A PARTY TO DISPUTE IN CHINA

The World Trade Organization (WTO) is an international system that constitutes an instutitional and judicial international body dealing with the global rules, process and procedure of trade between nations. The rules of the WTO are more detailed and comprehensive than those of the General Agreement on Tariffs and Trade (GATT). The WTO replaced the GATT in order to ensure the resolution of commercial disputes between member states and so as to construct a dispute resolution system. The system is based on the Understanding on Rules and Procedures Governing the Settlement of Disputes (DSU) as a result of achievements reached over a long period of time and experience gained concerning the settlement of disputes in accordance with the established rules and methods of detection. The DSU encompassed concerned with disputes arising from resolution rules and methods regarding the WTO Agreement, the GATT 1994 system, all other merchandise trade agreements, the General Service Agreement on Trade and the Trade-Related Intellectual Property Rights Agreement. In this study there was an examination and evaluation of the dispute resolution system and how the system in question is a party to disputes in China.
